Ohio joins health
care reform lawsuit
Wednesday, January 19, 2011
Florida Attorney General Pam Bondi on Tuesday filed a motion to add
Ohio and five other states to the federal health-care lawsuit, which is
challenging last year's reform law as unconstitutional.
In addition to Ohio, Iowa, Kansas, Wyoming, Wisconsin and Maine joined
the suit.
The motion brings the total number of states to 26, including Florida
and the National Federation of Independent Business. Newly elected
Republican Attorney General Mike DeWine last week wrote to Bondi
seeking an OK to add Ohio to the suit, reversing the stance of
Democratic predecessor Richard Cordray.
The federal lawsuit fights the law’s “individual mandate” requiring the
purchase of health insurance. A separate federal lawsuit filed by
Virginia challenged the law on similar grounds and last month received
a favorable ruling declaring the mandate unconstitutional, but other
decisions have upheld the law. That leaves its likely resolution to the
U.S. Supreme Court.
Prior to Tuesday’s filing, the Florida-led lawsuit included Alabama,
Alaska, Arizona, Colorado, Georgia, Idaho, Indiana, Louisiana,
Michigan, Mississippi, Nebraska, Nevada, North Dakota, Pennsylvania,
South Carolina, South Dakota, Texas, Utah and Washington.
