Election Day confusion on provisional ballots stayed by court
Third consecutive ruling upholding Secretary of State
COLUMBUS – Regarding today’s decision by the Sixth Circuit Court of
Appeals to grant a stay in SEIU v. Husted, see attached, all of the
following may be attributed to Ohio Secretary of State Jon Husted:
“With six days to go before Election Day, I am pleased that the Court
has granted a stay in this case so that I can give the 88 county boards
of elections the clear direction they need on the rules for processing
provisional ballots.
“The decision of the lower court was outside of the scope of the
original litigation and had the potential to cause significant problems
and confusion on Election Day. Voters could have cast ballots wherever
they wanted to in the county, regardless of their eligible precinct.”

COLUMBUS – Regarding today’s decision by a federal court in the case of
Fair Elections Ohio v. Husted, all of the following may be attributed
to Ohio Secretary of State Jon Husted:
“I welcome the fact that this is the 3rd consecutive court case ruling
in our favor. With the conclusion of this case, I am pleased that
there are no more pending lawsuits that will affect the election.”
“The rules are clear and we can now focus on running a fair election.”
