Grisez ordered to return to jail
for address violation

GREENVILLE
– John Grisez was
returned to the Darke County Jail on Jan. 12 to finish his eight months
incarceration. Grisez, a sex offender required to report his address,
was
charged with a Failure to Register a New Address with the Darke County
Sheriff,
a Felony 1 offense.
According
to Darke County Assistant
Prosecutor Deborah Quigley, the charge had to be amended to a Felony 3
offense,
because his crime was classified under Megan’s Law. The Felony 1
against Grisez
had been filed under the Adam Walsh Law, which carried a much harsher
penalty.
A Supreme Court ruling that came out about the same time, however, did
not
allow that option.
Quigley
told Common Pleas Judge Jon
Hein, pursuant to a plea agreement, Grisez could be released to
community
control if he had a valid address. He has none at the present time.
Grisez’
attorney, Paul Wagner,
Greenville, said his client tried to find a job but due to his
situation wasn’t
able to. He moved to Chicago where he thought he could find a job. He
tried to
register there but couldn’t because he didn’t have a job.
“I
tried and tried,” Grisez told
Hein. “I was told I got to get a new I.D. It was hard to get one
because I wasn’t
working at the time.”
Hein
acknowledged the defendant’s
ability to comply is dependent on getting a job. He also noted that
Illinois
isn’t likely to allow him into their system without the job and a
residence
address.
“I’ll
stay here until I get a job
in Chicago,” Grisez said. “You have to give me a chance.”
Hein
told the defendant he would
have to remain in jail for eight months with credit for time served. He
would
also be responsible for court costs.
“This
should give you time to make
arrangements so that you have a place to stay when you are released,”
Hein
said.
Quigley
later said he wants to move
to Chicago but can’t get registered. That creates a violation here.
Unless
someone is willing to sponsor him in Chicago, the move isn’t likely to
happen.
