Shannon gets a year for
aggravated
vehicular assault

GREENVILLE
– “I have no option but
to send you to prison,” Common Pleas Judge Jon Hein told the defendant,
Bryan
L. Shannon. Shannon pleaded guilty to Aggravated Vehicular Assault, a
Third
Degree Felony, Aug. 12. Prison was mandatory for the charge.
Hein
noted the defendant had
numerous disorderly and traffic offenses. He had a substance abuse
history, and
employment and acquaintance factors were moderate to high risk.
“You
have prior felonies in 2002
and 2008. There was a DUI in Eaton in 2012 and in 2007, a menacing
charge in
Montgomery County. The times in between no trouble… did something throw
you off
or did you just not get caught?”
Shannon
also had two prior DUI
charges in Darke County, one of them including leaving the scene of an
accident.
Hein
said the risk of recidivism is
likely, then asked Shannon… “You have been through the support systems
before,
haven’t you?”
Shannon’s
attorney, Michael Rieman,
told Hein the defense understands the mandatory minimum. “I would like
to ask
the court to stick to that,” he said. “The victim was Mr. Shannon’s
friend. I
understand there is no ill will.”
Darke
County Prosecutor R. Kelly
Ormsby concurred, indicating the victim was not cooperative with the
prosecution’s case.
Hein
ordered Shannon to serve the
full 12 months with no credit for time served, a one year license
suspension,
court costs and mandatory post release control for three years. He
noted there
didn’t appear to be any victim restitution.
