Houdeshell pleads guilty to two counts of F3 Burglary

GREENVILLE – Bryan A. Houdeshell pleaded guilty Nov. 4 to two counts of Felony 3 Burglary. An original charge of Felony 2 Burglary was revised to F3 in return for the plea. The pleas were for burglaries on July 31 and Sept. 13.

The maximum penalty for each charge is three years in prison plus a $10,000 fine; terms could be served consecutively. In the plea agreement, Prosecuting Attorney Kelly Ormsby agreed to recommend a sentence of one year on each case, to be served concurrently, along with restitution and court costs. He also noted the defendant would be free to argue the appropriate sentence.

David Rohrer, Houdeshell’s attorney, had no additional comments on the agreement.

Darke County Common Pleas Judge Jonathan Hein advised Houdeshell if a prison sentence is imposed there will be mandatory parole supervision for up to three years.

Hein also advised Houdeshell of his rights and the rights he was giving up by pleading guilty, including the right to a jury trial. When asked how he pleads, Houdeshell said guilty to both counts.

Following a pre-sentence investigation, sentencing will take place Dec. 16.

Houdeshell was convicted of Felony 3 Robbery on March 21, 2006, and sentenced to a year in prison.
