GREENVILLE
– “All that stuff you said about wanting to do better… only
words. It’s your actions that count. You’re 44. There’s no
excuse.”
Darke
County Common Pleas Judge Jonathan Hein told Patrick J. Flint, Ft.
Recovery, he heard the defendant blame others three times and say
twice “I should have been smarter.” Hein said the criminal record
indicates Flint consistently takes the wrong steps, then noted “you
couldn’t keep the appointments I told you to make.” The broken
appointments were with John Tabler, Darke County adult probation
officer.
Hein
then sentenced Flint to 30 days in jail for Petty Theft plus 30 days
in jail for Non-Support, to be served consecutively. He added,
however, he was giving Flint what he’d requested: the time to start
a job and keep it, allowing for work release as he served his jail
time. He told the defendant he needed to present himself to the Darke
County jail Feb. 22 at 9 a.m. to begin serving his term. Hein also
imposed 150 days of unsupervised probation for the theft charge.
“Assistant
Prosecutor Jesse Green is going to show up at my door and say ‘I
told you so’ if you don’t do this. I’m giving you what you
asked for… a chance to show up. Do your time.”
Both
Green and Assistant Prosecutor Deborah Quigley were in court Feb. 11
regarding the two sets of charges. Green recommended 30 days for
non-support while Quigley asked for 90 days on the theft.
“There
has been no restitution,” Quigley said, “and he has a long
history of criminal offenses. Community control won’t do anything.”
Flint’s
attorney, Michael Reman, acknowledged his client was wrong but noted
Flint was taking items sitting outside, valued at less than $100.
Flint
spoke several times on his own behalf, noting he wanted to try to
make better decisions in the future.
Darke
County court records show 16 criminal charges dating back to 1993.
Most were theft charges, including one Theft from the Elderly. Court
records also show several miscellaneous charges, including traffic
violations.
