
DUI
On December 2nd, 2025, at approximately 1816 hours, during routine patrol I observed a vehicle traveling northbound on Walnut St, that ran a stop sign at the intersection of East 3rd St. and Walnut St.
I activated my overhead lights and conducted a traffic stop for the aforementioned offense. The vehicle, a 2015 Chevy Silverado, bearing a West Virginia registration BRO239. I approached the vehicle and contacted the driver, Rodney Kiser. I explained to Kiser the reason for my stop and requested his driver’s license and proof of insurance. Additionally, I asked Kiser if he had any firearms in the vehicle. He advised that he had a hunting rifle which was visible in the front passenger seat. I asked Kiser if he had any other handguns to which he replied no. While Kiser was retrieving the requested information, I noticed an open pack of Busch Light beer sitting in the front passenger seat. I asked Kiser if he had been drinking tonight which he initially replied no. I indicated that there was an open pack of beer in the vehicle which Kiser stated that he had a couple. I asked Kiser when he had consumed the alcohol which he replied a few hours ago. I inquired how long ago and he replied 1 to 2 hours.
I then went back to my cruiser to run Kiser’s information. I returned to the vehicle to speak with Kiser who advised that he was just driving around and wanted me to let him go home. I asked why he thought that I wouldn’t let him go home? He then said. “Can I be honest with you?” I replied yes. He said that he had stuff going on at home and that he had just started driving. It was at this time that I noticed Kiser slurring his speech as if he was impaired. Kiser then said “Please, for the love of God just let me go home”. I asked Kiser where he lived and he advised Preston County West Virginia. I told him that West Virginia was a long drive, and he said he was trying to get a room at the Stardust Motel, but they would not let him with his dogs. I then asked Kiser why he kept wanting me to let him go home. Kiser then said, “Can’t you just help me get somewhere where I can spend the night?” I again noticed Kiser slurring his speech and advised him that if he was fine to drive then I wouldn’t need to follow him and that I did not believe that he was fine to drive. Kiser said that he was fine to drive. I then said to Kiser, ” Be honest with me man. How many of those Busch Lights you drink today?” Rodney then said, ” More than- more than you should let me go sir”. I then told Kiser that I could not let him leave and instructed him to turn the vehicle off and place the keys on the dash which he did.
I then requested another unit to conduct a Standardized Field Sobriety test. I asked Kiser if he wanted to conduct the SFST which he said he would. Once Kiser exited his vehicle, I could smell an odor of an alcoholic beverage on his person.
I had Kiser stand in a fixed position to perform the HGN (Horizontal Gaze Nystagmus). While conducting the test I observed 2 clues for lack of smooth pursuit and two clues for nystagmus for distinct nystagmus at maximum deviation.
Next, I had Kiser perform the walk and turn where I had Kiser stand in the starting position while I explained the instructions. Kiser started the test before instructions were completed as well as failed to walk touching heel to toe.
Finally, I had Kiser conduct the one leg stand and instructed him to stand in the starting position while I explained the instructions. Kiser indicated that he understood the instructions and began the test. Kiser was swaying while attempting to count and was unable to keep his foot raised, putting his foot down more than 3 times.
At this point I believed that Kiser was impaired and was placed under arrest for suspicion of OVI. I placed Kiser and handcuffs which were gap checked and double locked. Kiser was then placed in the back of my cruiser and read his Miranda rights which he indicated that he understood. I then searched the immediate area of vehicle where he was seated, incident to arrest where I located two open cans of Busch Light which were partially consumed as well as a loaded TC Encore ProHunter located in the front passenger seat, and a Smith and Wesson MP 40 located on the right side of the steering column. Kiser, when asked earlier if there were any other firearms in the vehicle besides the rifle, stated that there were not. The two firearms were collected as evidence and placed into property.
Kiser had two dogs with him at the time of the stop. The dog warden was notified, and the dogs were taken by the dog warden to the Darke County animal shelter. Hurd’ stowing was contacted to tow the vehicle as Kiser did not have anyone who could get the vehicle and the vehicle was not parked legally. Kiser was transported to the Greenville Police Department and was read the BMV2255 form in the presence of Officer W. Nibert where he stated he understood. Kiser was given the chance to provide a breath sample on the Intoxilyzer 8000 where he voluntarily gave a breath sample.
The breath sample from Kiser resulted in Kiser having a BAC of.193 (Breath Alcohol Concentration of 25 hundredths of one gram of alcohol by weight per 210 Liters of his breath). Kiser was given his copy of the BMV2255 as well as a copy of his test results.
Kiser was charged with 4511.43( A) Right-of-Way rule at through highways, stop signs, yield signs a Minor Misdemeanor, 4511. 19 (A) (1) (A) OVI a Misdemeanor of the 1st degree, 4511. 19 ( A) ( 1) ( H) OVI a Misdemeanor of the 1st degree, and 29. 16 (D) (1) Improperly Handling Firearms in a Motor vehicle a Felony of the 5th degree.
Kiser was transported to the Darke County Jail by officer W. Nibert and released to jail staff.
Drugs
On December 6th, 2025, at approximately 1026 hours, I was on routine patrol when I observed Brandy Clay walking towards the front porch of 331 West Water Street, in the city of Greenville.
I had prior knowledge that Brandy had an active felony warrant for her arrest through the Montgomery County Sheriff’s Office for a Probation Violation on an original charge of Possession of Drugs.
I exited my police cruiser and made contact with Brandy and detained her in handcuffs which were double locked and gap checked. Brandy was advised of her warrant and confirmed her identity with her name and date of birth which was ran through LEADS/NCIC via GPD Dispatch who confirmed her warrant.
While searching Brandy incident to arrest, a plastic baggie containing an unknown substance was located in her front right jeans pocket. When I asked Brandy what the substance was, she stated she did not know, and they were not her pants.
Brandy was transported to the Darke County Jail and incarcerated for her warrant.
The backseat of my police cruiser 1937 was checked prior to and after transport and no contraband was located.
The unknown substance was transported to the Greenville Police Department and packaged and placed into property as evidence. The unknown substance will be sent to the BCI Crime Lab for analysis. I will follow up with the results in case management.
Wanted Person
On December 9th, 2025, at approximately 2052 hours I observed the listed 2013 Ford traveling southbound on Sweitzer Street near Eidson Road. The vehicle’s driver’s side headlight was out.
I conducted a traffic stop on the vehicle and made contact with the driver, Enrque Flores and the passenger, Joshua Keehner. I asked Joshua if he would provide his driver’s license. Joshua provided his driver’s license and dispatch checked it through LEADS/NCIC.
Dispatch advised Joshua had an active arrest warrant through Preble County for a Child Support violation.
I placed Joshua in handcuffs and they were double locked and gap checked.
Dispatch confirmed the warrant through Preble County Sheriff’s Office and they agreed to meet near the county line to do a prisoner exchange.
Enrique was issued a warning for the headlight and was released. I transported Joshua where he was released to a Preble County Deputy.
I checked the back seat of my cruiser before and after the transport, I located nothing.
