On December 12th, 2025 while on patrol I got behind the listed 2005 Honda on Grant St near E Fourth St in the city of Greenville, Ohio. I followed the vehicle on Grant St to E Main where I observed the vehicle fail to signal its turn prior 100 feet to go eastbound onto E Main St. I then initiated the traffic stop. The driver of the vehicle and was slow to stop and drove approximately two blocks stopping at E Main and Tecumseh.
I made contact with the operator/defendant Justin Canan and advised him the reason for the stop. Canan was cooperative with furnishing his driver’s license and proof of insurance. When asked about if there were any weapons or drugs in the vehicle he stated that he had a, “roach” from earlier. A roach is a common termed for a partially smoked Marijuana cigarette. Canan denied being the one who smoked the Marijuana. Canan gave consent to search his vehicle. Canan stepped out of his vehicle and also gave consent to search his person. Nothing was located on Canan’s person.
While searching the vehicle I located a bag of what appeared to be Psilocyn Mushrooms in the center console. I held the bag up and shined my light on the bag and Canan stated, “I forgot about that.” Lt Monnin then detained Canan and placed him into handcuffs and gave him his Miranda warning. When asked about the mushrooms Canan stated it would be, “less then a quarter” referring to the weight of them.
Upon PO Wolfe’s arrival Lt Monnin assisted me in searching the vehicle. Lt Monnin located a glass smoking device or “bubble” stuffed under the dash between the steering wheel and plastic in the steering column. The “bubble” is a common smoking device for Methamphetamine and had residue that was consistent with Methamphetamine use.
Lt Monnin then did a thorough search of Canan’s person and while doing so Canan stated, “The cat is out of the bag at this point” and stated the bubble is what his stressor was. Canan then stated again that he forgot the mushrooms were in the vehicle. No other illegal substances were located.
The suspected Psilocyn Mushrooms and the glass smoking device was seized and transported to the Greenville Police Department. The suspected Psilocyn Mushrooms will be sent to the lab and a grand jury indictment will be pending lab results.
DUI
On December 12th, 2025, at approximately 1935 hours I was dispatched to the area of North Broadway Street and Russ Road reference a call from Darke County Sheriff’s Department reference a vehicle headed into Greenville that was swerving in the roadway.
A witness, Craig Carey, called DCSO and stated that he was following a dark-colored chevy truck that was traveling southbound on State Route 118. Carey advised DCSO that the truck was all over the roadway and almost hit a parked car in Ansonia. As Carey continued to follow the vehicle, he advised that the vehicle would go into the ditch when oncoming traffic was approaching on State Route 118. Upon entering the City of Greenville, Carey advised that the vehicle he was following, which was bearing the Ohio registration KMW6284, had gone up on the curb before turning eastbound onto Russ Road. The vehicle in question turned into 1120 Russ Road Greenville, the Taco Bell parking lot, and parked which is where I first located the vehicle.
Carey advised he would provide a witness statement which will be attached to this report when it’s provided.
I approached the vehicle, a dark colored 2005 Chevy Avalanche (KMW6284), and made contact with Ezra Setser who was the only individual in the vehicle and was seated in the driver’s seat when I advised him of the complaint. Setser advised that he was coming from a Christmas party and was heading to Taco Bell for food before returning home to 1370 Benden Way C13 in Greenville.
Due to the nature of the call, I asked Setser if he would be willing to submit to Standardized Field sobriety Test. He agreed to conduct the SFST and exited the vehicle. I asked Setser if he was on any medication prescribed to him by a physician. Setser replied that he was on medication for psoriasis. I then asked Setser if he had any recent head injuries to which he replied, ” not that I’ve been prescribed, sir”.
I then had the defendant remove his hood and hat to begin the SFST. I had the defendant stand in a fixed position to perform the HGN (Horizontal Gaze Nystagmus). While conducting the test I observed lack of smooth pursuit in both eyes, distinct nystagmus in both eyes at sustained maximum deviation, and onset of nystagmus before 45 degrees for a total of 6 clues.
Next, I had the defendant perform the walk and turn where I had the defendant stand in the starting position while I explained the instructions. The defendant moved his feet to keep his balance during the instructions, stopped to balance himself, did not touch heel to toe on the steps, raised his arms approximately 6 inches for balance, and stepped offline while walking, for a total of 5 clues.
Finally, I had the defendant conduct the one leg stand and instructed him to stand in the starting position while I explained the instructions. The defendant indicated that he understood the instructions and began the test. The defendant was swaying while attempting to count, and was unable to keep his foot raised, putting his foot down more than 3 times, for a total of 3 clues.
After the tests I asked the defendant if he had anything to drink tonight, which he advised that he may have had consumed 1-2 Busch Lights at around 1600 hours.
The defendant denied having anything else to drink that evening.
At this point I believed that the defendant was impaired and placed him under arrest for OVI. I placed the defendant in handcuffs which were gap checked and double locked. The defendant was placed in my cruiser and read his Miranda Rights which he indicated he understood. Once in the back seat of the cruiser, I was able to detect the odor of an alcoholic beverage coming from the Setser. The defendant was transported to the Greenville Police Department, and his truck was locked and remained in the Taco Bell parking lot. Upon arrival at the Greenville Police Department, the defendant was read and shown the BMV2255 form in the presence of Officer Russell where he indicated he understood. The defendant was given the opportunity to provide a breath sample but refused to provide one. The defendant was advised of the consequences of not providing a sample and he again refused to provide a breath sample. The defendant was given his copy of the BMV 2255 form as well as his copy of the denial to provide a breath sample form the Intoxilyzer 8000. The defendant was placed under an Administrative License Suspension (ALS) and his license was seized.
The defendant was issued a citation for 4511.19(A) (1) (a) OVI, a misdemeanor of the 1st degree, and advised of his mandatory court date and time and released to his mother, Melissa Setser.
