On July 10, 2024 at 2:53 PM police was dispatched to 750 Martin St. to assist the Darke County Humane Society with making contact with a dog owner. Sherry Burk with the Humane Society stated that she received a phone call from Angel Price. Angel had stated that Brianne Baker has three dogs inside this residence that are not being fed and they do not have access to water. While attempting to make contact at the residence, Sherry received a phone call from Angel Price. Angel stated that the dogs owner and Angel’s son, Zach Gilbert were in a vehicle at Darke County BMV. Sherry requested GPD to stand by to keep the peace while she makes contact with Brianne Baker. Upon arrival at the BMV, Sherry and PO spoke with Brianne. Brianne stated that they are getting a title to a vehicle switched into her name and it was going to take awhile. Sherry made arrangements for Brianne to surrender the dogs to the Humane Society. Sherry wrote down Brianne’s phone number and made an appointment to surrender the dogs at the Humane Society at 5pm on 7-10-24. PO cleared the call as a keep the peace with no further follow up needed due to the owner surrendering the dogs without issues. At this time PO had not seen the dogs. On 7-11-24 PO was contacted by phone by Sherry Burk about the surrender of the dogs from the night before. Sherry stated that Brianne Baker brought two dogs to the Humane Society. Sherry stated Brianne told her they would keep the third dog but were surrendering the other two. Sherry stated that both dogs appeared to have been neglected but especially the Brown male Pitbull, “Barney”. Sherry stated shortly after Brianne left the Humane Society, Angel Price called again stating that the third dog that was kept by Brianne Baker had died. Angel stated that they buried the deceased dog in the back yard of 750 Martin St. Angel could not say how the dog died. PO went to the Darke County Humane Society to view the conditions of both dogs. Photos were taken of both dogs. PO learned from Sherry Burk that the Brown male Pitbull was named “Barney” and the Brown and White mixed breed dog was named “Belle”. Both dogs were taken to Bruns Animal Clinic for health checks. Sherry provided the investigation a vet report and letter from Bradley Bruns stating his professional opinion was that the dogs were neglected. “Barney” weighed 21. 4 pounds. The average weight for this breed should be 65 – 75 pounds. On 7-18-24 PO was able to speak with Brianne Baker by phone. She advised that she could not come to GPD station to speak with this officer today. She was advised to call on 7-19-24 to write a statement at GPD. A citation was prepared and she will be served when located. On 7-20-24 Brianne Baker arrived at the GPD. She was given a statement to fill out. She wrote in her statement that she found the dogs and only had them for 2-3 weeks. PO questioned her about the third dog that was never surrendered. PO advised her that it was reported that the third dog was possibly deceased and buried in the back yard of 750 Martin St. Brianne stated the third dog was a different dog but they did have a puppy that was 3 months old pass away. She confirmed that it was buried in the back yard of 750 Martin St. PO made contact with Dr. Bradley Bruns of Burns Animal Clinic. I asked him his professional opinion that if someone found a dog in “Barneys” condition, if 2-3 weeks was enough time to get the dog closer to a healthy weight if properly cared for. Dr. Bruns advised 2-3 weeks was plenty of time to get the dogs weight up to healthy conditions. Dr. Bruns provided a vet bill and a written statement that was his opinion that the dogs had “obviously been neglected.” On 7-20-24 Brianne Baker was issued a citation for Cruelty to Animals. PO will need this case assigned in case management to follow up on Aug 1st. This is to take photos of the dog after it has been in the Humane Society’s care for 3 weeks time.
