DUI
On February 24th, 2026, at approximately 2131 hours I was dispatched to the intersection of East Fourth Street and Tecumseh Street in the City of Greenville in reference to a two-vehicle accident without injury.
Upon arrival I made contact with Zachary Unger. Zachary stated he was traveling west bound on East Fourth Street in his 2016 black Ford Taurus and was on his phone. Zachary stated he was distracted and struck a 2004 Honda CRV parked just off the roadway facing west bound on East Fourth Street. I observed disabling damage to the entire front of Zachary’s vehicle. I also noticed disabling damage to the rear passenger side of the parked vehicle that Zachary struck. I observed Zachary’s eyes to be glossy and he was slurring his words as he spoke with me. I asked Zachary if he wanted to sit in the backseat of my cruiser while I collected the other vehicle’s information and he did ask to sit in the back seat of my cruiser. I placed Zachary in the backseat of my cruiser and began to collect information for the crash report. Zachary was on the phone with a friend while he was sitting in the backseat of my cruiser and the friend was advising Zachary to refuse “All tests”. I overheard this conversation while I was sitting in the front seat of my cruiser conducting part of my investigation.
I opened the my cruiser door and asked Zachary to speak with me at the front of my cruiser. I asked Zachary where he was coming from and he stated he was coming from a friend’s house. I could smell the odor of an alcoholic beverage on Zachary’s breath as he was speaking to me. I asked Zachary if he had anything to drink and he stated that he did not. I asked Zachary if he would submit to any standardized field sobriety tests and he refused. I placed Zachary in handcuffs and advised him of his Miranda warning. The handcuffs were gap checked and double locked. I placed Zachary in the backseat of my cruiser.
I took photographs of Zachary’s vehicle and added them to this report. I conducted an inventory of Zachary’s vehicle and the only thing of value that I found was a black watch. I removed the watch from the vehicle and asked Zachary if he wanted to keep the watch with him or leave it in the vehicle and he stated he would keep it with him. I could smell an abundance of an alcoholic beverage coming from the backseat of my cruiser when I was speaking to him. Zachary’s vehicle was towed by Dillman’s towing and was transported to their lot. I transported Zachary to the Greenville Police Department.
Upon arrival I read Zachary his BMV-2255 form and I asked him if he would submit to a chemical breath test. Zachary refused the chemical breath test. P.0. Daugherty was speaking with Zachary, and he admitted to drinking beer at his friend’s house before driving. Zachary was issued a copy of the BMV-2255, a copy of the intoxilyzer refusal and a citation for failure to maintain reasonable control of a motor vehicle and OVI. Zachary was advised of his mandatory court date, advised of his immediate license suspension and was released to his father.
