Due to the frequency and the types of criminal activity at 229 Hart Avenue, I prepared a City of Greenville Nuisance Abatement Code Notice and Order. The frequency and types of criminal activity at this address disturbs the life, peace, quietude, health, safety, and general welfare of the inhabitants of the City.
I performed a search of the Darke County Auditors website and learned that the owner of the property is Brian and Jennifer Baker.
On April 24th, 2026, I served this notice to Troy Vanden & Rebecca Braun at 229 Hart Avenue, and the owner, Brian Baker at 5682 Requarth Road.
Vandalism
On April 25, 2026, at approximately 1114 hours, I responded to 435 East Third Street in reference to a vandalism.
Upon my arrival, I made contact with the complainant/victim, Patrick Eichelberger. Patrick advised he went out to his detached garage around 1000 hours this morning and noticed damage to his garage door. I observed damage to a panel on the garage door and tow rails as well as damage to the siding near the door. Patrick advised he did not notice any damage to the garage last night 04/24/26 as he was working in the garage and went inside around 2145 hours. I did not observe any cameras in the area of this incident. Patrick stated he does not know of any possible suspects at this time. Pictures were taken of the damage and will be attached to this report.
Patrick was given a statement and victim rights form, which were completed and returned back to me.
Wanted Person
On April 25, 2026, at approximately 1710 hours a known wanted person was apprehended at 1325 Mar del Drive Apt #2 in the City of Greenville.
I had prior knowledge that Charles Hawes had an active arrest warrant for aggravated possession out of Darke County with no bond. Charles lives at the listed address; upon my arrival I knocked on the door where a male came to the door where I asked him if he was Charles. He said yes and he was advised he has an arrest warrant. Charles provided me with his driver’s license where dispatch confirmed his warrant. Charles was placed into two sets of handcuffs and that were double locked and gab checked. Charles was transported to the Darke County Jail and released to jail staff without further incident. The backseat of my cruiser was checked prior and after transport with nothing being located.
Nothing further.
Trespassing
On April 24, 2026, at approximately 1154 hours, I was dispatched to the Greenville City North Park; 400 Lease Avenue, in reference to a trespassing complaint.
I had prior knowledge of a subject, Justin Glass, living in the park area, as I had spoke with him in reference to this issue the day before. During that interaction, Justin advised he is currently homeless and was instructed to come to the park due to there being no where else for him to go. Justin stated several city employees advised him he was allowed to. At this time I advised Justin the park was only open from 0600 to 2200 hours, and he was not to be in the park after park hours.
The Greenville Street Department provided pictures through email from a camera in the area showing Justin entering the men’s bathroom at 2329 hours on 04/23/2026 and leaving the same bathroom at 0721 hours on 04/24/2026, indicating he slept there overnight. I made contact with Justin at the Greenville City North Park. Upon speaking with Justin, I asked him if he remembered what time I had advised him the park closed, to which he stated he did not. I asked Justin if he noticed any signs in the area outlining the park hours, to which he also stated he did not. I advised Justin to look at the men’s bathroom door, which a sign is posted on stating the park hours. Justin stated again he believed he had permission to sleep there for the time being. I advised Justin he would be issued a citation for criminal trespass. Justin stated he has no where to go at this time, and does not know of anyone he can contact for assistance.
While leaving the park, I spoke with a street department employee, Cody Nealeigh. Cody advised he and no one with street department gave permission for him to sleep there.
Justin was issued a citation for criminal trespass, a 4th degree misdemeanor, and was advised of his mandatory court date and time.
