

Trash/Dumping
On August 22, 2025 at approximately 1341 hours, I was dispatched to the area of the 600 block of South Broadway Street in reference to a homeless man, Michael Falkner, leaving trash and debris at the park bench that he had been sitting on. Upon my arrival I spoke with the complainant/witness, Barbara Miller. Barbara advised that she works at her brothers shop, Michaels Clocks (601 South Broadway Street). She advised that all day long she had observed Falkner sitting on the bench in front of the listed business. She advised that throughout the day Falkner had been smoking cigarettes and throwing the cigarette butts down on the public sidewalk where he had been sitting. She advised that Falkner also was given a bottle of water and a 20 oz bottle of Coke-a-Cola by passersby. Barbara observed Falkner drink the contents of the bottles and then begin putting his used cigarette butts in the used bottles. I was able to observe the used bottles of water and Coke-a-Cola sitting under the park bench with an estimated 20+ used cigarette butts under and around the public sidewalk bench that Falkner was observed to be sitting on throughout the day by several officers including myself and witness, Barbara. Barbara advised that she, without a doubt, observed Falkner to have been using the two listed bottles to drink from and also to use as an “ashtray”. Upon my arrival and through my conversation at the listed location on South Broadway Street, I did not observe Falkner to be around in the area. Barbara was given and completed a witness statement form that is placed into Greenville PD records. I was able to take photographs of the listed trash that was left in front of the listed business at 601 South Broadway Street. Photographs were placed into records at Greenville PD as evidence. After speaking with the administration at Greenville PD and also the shift Sgt. it was determined that Falkner would be receiving a citation for littering. Falkner was located on August 24, 2025 in front of the same business, sitting on the same park bench. He was subsequently issued a citation for Littering. He was given a copy of his citation and all other necessary paperwork.
Wanted Person
On August 29th, 2025 at approximately 1841 hours I apprehended a known wanted person. On the above date and time I had prior knowledge that Jeremy Jones had a warrant for his arrest. As I was on routine patrol I noticed the garage door at 110 Sixth St open. This address is where Jeremy currently lives. I was able to identify Jeremy Jones standing inside the garage. I exited my cruiser and made contact with Jeremy and advised him he had a warrant out of Logan County for failure to appear on non support of dependent, no bond. Jeremy was placed in handcuffs that were gap checked and double locked. I transported Jeremy to the Darke County Jail where he was released to jail staff. The back seat of my cruiser was checked prior to and after the transport.
Wanted Person
On August 29th, 2025, at approximately 1949 hours I dispatched to 225 Birt St. in reference to hypodermic needles being found. Upon my arrival at the listed address, officers made contact with Jacob Marando who was known to have a warrant out of Darke County Sheriff’s Office. Dispatch confirmed that Jacob had an active warrant for failure to appear with no bond. I placed Jacob in handcuffs which were gap checked and double locked. Jacob was searched incident to arrest and no contraband was found. Jacob was transported to Darke County Jail where he was incarcerated. I checked my cruiser before and after transport and no contraband was found.
DUI
On August 30th, 2025 at approximately 0149 hours while on patrol in the city of Greenville, Ohio 45331, I observed a vehicle travelling northbound on Wagner Avenue near Russ Road. The vehicle appeared to be travelling faster than the posted speed limit. I activated my speed measuring device and it returned with a speed of 46 MPH. The posted speed limit on Wagner Avenue is 35 MPH. I subsequently initiated a traffic stop on the vehicle. Upon making contact with the driver, I learned him to be Brian Staley ( the offender). Brian was operating a white 2020 Chevy Blazer bearing Ohio registration BTYWT. I advised Brian of the reason for the stop and asked for his driver’s license, registration, and proof of insurance. As Brian was gathering his information, I observed two bottles on the back seat floorboard of the vehicle which appeared to be alcoholic beverages which were opened as some of the liquid content of the bottles was missing. I asked Brian if there was any weapons, drugs, or alcohol in the vehicle to which he replied there was not. I had dispatch verify the information through LEADS/NCIC. Dispatch advised Brian was a valid driver. I asked Brian a second time if there was any alcohol in the vehicle and if he had been drinking. It was at this time Brian reached into the back seat and stated there were two bottles of liquor in the back. Brian then grabbed the bottles and showed them to me. One of the bottles was Bacardi which is a clear liquor with an alcohol content of 40% ALC/VOL. The other bottle was Absolute Raspberry which is raspberry flavored Vodka. The second bottle was also a clear liquor with an alcohol content of 38% ALC/VOL. It was at this time I asked Brian to step out of the vehicle. Once Brian was out of the vehicle, I notified dispatch of my findings and asked for an additional unit. While waiting on another unit I asked Brian if he would be willing to perform Field Sobriety Tests. While speaking with Brian, I was able to detect a very strong odor of an alcoholic beverage coming from his breath and person. Brian stated he would. A short time later, P.0. M. Colby arrived on scene. I began performing the Field Sobriety Tests on Brian and the results were as follows. Horizontal Gaze Nystagmus- I explained the test to Brian and also asked if there was any reason why he wouldn’t be able to complete the test to which he replied no. Brian was showing signs of nystagmus in his left and right eye during the Distinct Nystagmus at Maximum Deviation portion of the test. Brian was showing signs of nystagmus during the Lack of Smooth Pursuit portion of the test in both the left and right eye. Brian did show signs of nystagmus in the right eye during the Onset of Nystagmus before 45 degrees. Brian performed poorly on this test. Walk and Turn- I explained the test to Brian and demonstrated the test. I asked Brian if there was any reason why he would not be able to complete the test to which he replied no. Brian was unable to remain in the starting position while I explained and demonstrated the test as he moved his feet to keep his balance. Brian stopped walking during the first portion of the test to steady himself. Brian was also unable to walk in a straight line during the test. Brian performed poorly on this test. One Leg Stand- I explained the test to Brian and demonstrated the test to him. I asked Brian if he understood the test to which he replied he did. Brian was unable to keep his balance during the test as he was swaying before and during the count. Brian raised his left arm six inches during the test for balance. Brian also put his foot down after starting the test to keep his balance. Brian performed poorly on this test. It was at this time I advised Brian to turn around and place his hands behind his back. I informed Brian he was under arrest for Operating a Motor Vehicle while Impaired. I put Brian in handcuffs which were gap checked and double locked. I placed Brian into the backseat of my cruiser (1946) which was checked before and after transport where no contraband was located. P.0. M. Colby began searching Brian’s vehicle which he consented to. P.0. M. Colby located the two bottles previously mentioned as well as a third open bottle of what appeared to be a dark colored liquor. The third bottle was located in the trunk of the vehicle. The bottle had Jack Daniels engraved on it but there was no label clearly identifying what the bottle contained. I asked Brian if he had someone who could drive his vehicle for him to which he replied his wife (Cynthia Staley) would be able to. Brian called his wife with his phone and she shortly thereafter responded to the scene. I then asked Brian if he would consent to taking a breathalyzer test to which he replied he would. I transported Brian to the Greenville Police Department (GPD) where he performed the test. While on the way to GPD, I advised Brian of his Miranda Rights and asked if he understood them. Brian advised he did understand and was willing to speak with me, stating, “I’ve got nothing to hide”. While at GPD, the defendant was read the BMV2255 form which he signed and advised he understood what I read to him. The defendant then took the breathalyzer where he blew a 0.075 of one gram by weight of alcohol per two hundred ten liters of the person’s breath. I asked the defendant at that time if he consumed any sort of THC to which he replied he did not. I explained my findings to the defendant and advised he would be receiving a citation for Speeding and Operating a Motor Vehicle while Impaired. The defendant advised he understood and did not have any questions for me. I issued the defendant a copy of his citation and advised him of his mandatory court date and time. Cynthia arrived at GPD a short time later to pick the defendant up. Photos of the bottles were taken at the scene (Please see photo log for further). The Radar used to measure Brian’s speed was checked for calibration before and after the traffic stop which checked accurately.
