Trespassing

On January 11, 2024 around 4:52AM police was dispatched to 423 W Fourth St apartment 3 in reference to a trespassing complaint that was turning into a fight, where a female had her head pushed against a door. Prior to his arrival PO was told the suspects trespassing at the property were Nathaniel Lazar and Paul Daugherty. PO parked in the back of the apartment building. When he exited the cruiser PO could hear a verbal argument coming from the front steps leading into the apartment. As PO approached he witnessed the defendant, now known to him as Nathaniel Lazar walking away from the front door. PO told Nathaniel to wait with him so PO could figure out if there was a physical altercation or if he needed trespassed from the property. PO noticed Nathaniel had a strong odor of an alcoholic beverage around his person and he appeared to be intoxicated, with slurred speech. Nathaniel would not wait with PO and kept walking. PO told Nathaniel again to wait with him, so he could investigate the scene. Nathaniel again refused and when PO went to grab for him he pushed PO away. Nathaniel was told he was going to be placed in handcuffs. PO grabbed him by his jacket and arm, and moved him to the side of the building at 423 W Fourth St so he could be handcuffed. Nathaniel shoved PO several times while PO was trying to cuff him. At this time the complainant, now known to PO as Betsy Brown came outside and started to yell at PO and get PO to release Nathaniel. Betsy also had a strong odor of alcoholic beverage around her person. It was unknown who Betsy was at the time and she appeared to be trying to interfere with Nathaniel’s detention. PO decided the safest option at the time was for him to take Nathaniel to the ground so PO could keep an eye on Betsy. PO wrapped up Nathaniel and initiate a seatbelt takedown. PO got on top of Nathaniel where PO remained. While on top of Nathaniel PO was approached by another subject, now known to PO as Paul Daugherty. PO was able to keep his arms around Nathaniel and held him on the ground while Paul walked around PO. Another PO arrived a few seconds later and Nathaniel was handcuffed before being placed in the back of the cruiser. Paul left the area when the other PO arrived on scene and could not be located. Betsy claimed she no longer wanted Nathaniel warned for trespass despite the original call. Betsy stated Paul had pushed her head against a door, but it did not cause her injury. Betsy did not wish to pursue charges against Paul or Nathaniel for trespassing, or the assault. There were no visible injuries to Betsy. Betsy and Nathaniel refused to fill out statements regarding this incident. Nathaniel had no visible injuries and denied medical care. Nathaniel was charged with obstructing official business.
