Structure Fire

On December 14, 2023 at approximately 9:50 PM police was dispatched to 436 East Fourth Street in reference to a Structure Fire. PO observed that a bedroom on the East side of the upper story of the residence was on fire. The Greenville Fire Department were already on scene upon PO’s arrival and performed a sweep of the residence with nobody inside being located. A short time later complainant/involved person; Curtis Scott arrived on the scene and stated that he had been inside the residence during the fire before leaving to call for help. Curtis was treated on scene by Greenville Rescue for minor injuries sustained as a result of the fire. Curtis stated that he has been working on the residence on the behalf of the owner; Kennith “Kenny” Rodgers who lives out of state. Dispatch checked for the owners of the residence and found that it was owned by Kennith and Trina Rodgers. Contact was attempted with the owners via telephone with contact being unsuccessful and a voicemail being unable to be left due to the inbox being full. Curtis stated that he had candles lit in the bedroom but “far enough away to not catch the blanket on fire” for heat. He stated that he woke up from sleeping with his bed being on fire. Curtis stated that he attempted to put the fire out but was unsuccessful and ultimately had to climb out of the second story window where he later fell to the ground after hanging there and yelling for help. After falling Curtis stated he ran to 209 East Main Street; Towne House Motel where he contacted 911 for help. The fire at the residence was able to be extinguished by the Greenville Fire Department. Curtis was transported to the Towne House Motel where he stayed for the night. At this time there is no follow up needed. On December 15th, 2023, at approximately 7:00 PM a PO also attempted to contact the owner of the property via telephone but was unsuccessful. The phone number is a good working number for Kenny Rodgers.

Menacing

On December 14, 2023 at approximately 5:02 PM police was dispatched to 695 Wagner Avenue; Rural King in reference to an instance of menacing. PO spoke with victim; Odin Zeller who stated that he had been in a verbal altercation with someone while he was in the store. Odin stated that the altercation with the suspect had originally occurred while at 415 Wagner Avenue; Aldi when Odin made a sarcastic comment to the suspect for being rude to a cashier at the business. Odin stated that the suspect told him that he needed “to mind his own fucking business” before flipping him off as Odin was leaving the area in his vehicle. After leaving Aldi Odin proceeded to Rural King where he went to get some items. While checking out at Rural King Odin stated that he observed the same suspect, from Aldi, at the entrance of Rural King. Odin stated the suspect then started yelling and cursing at him telling him he needed to mind his own business before eventually threatening him by stating that he “was going to beat his ass”. The suspect then left the area after being told to leave by employees of Rural King and left the area prior to officer arrival. The suspect was described as a larger older male wearing a plaid shirt, jeans, orange hat, and with a gray beard. Rural King employee/witness; Laurie Mills stated that she had heard and observed the incident and completed a witness statement that will be attached to this report. Witness; Justin Washington recounted a similar story to Odin and stated that the suspect left the area in a blue Chevrolet Cruze with Ohio personalized license plate JS619. Justin completed a witness statement that will be attached to this report. Dispatch checked the license plate in LEADS/NCIC and found that the license plate returned to the listed blue 2012 Chevrolet Cruze with Ohio license plate JS619. Leads/NCIC showed that the listed blue Chevrolet belonged to a Jane Smith out of Greenville, OH. Through some investigation it was found that suspect; Roby Smith was married to Jane and matched the description of the suspect. Odin agreed to participate in a photographic line up in order to help identify the suspect. On December 14, 2023 at approximately 5:34 PM Odin arrived at 122 West Main Street; Greenville Police Department to complete the line up. Odin was taken to interview room #2 where the photographic line up was conducted and PO acted as the blind administrator. During the course of the line up Odin identified two suspects. The first identified was Richard Tucker who Odin stated that he was 80-90% confident was the suspect. Richard does not reside in the area per the address listed in the BMV. The second identified was the suspect; Roby Smith who Odin stated he was 90-100% certain was the suspect. After requesting to see the two individuals that Odin identified he reconfirmed that he believed Roby to be the suspect. All documents used in the photo line up will be attached to this report please see them for further details. Odin completed a witness statement and victim rights form that will be attached to this report. When asked Odin stated that he felt threatened by the suspect during the incident. On December 15, 2023 at approximately 6:50 PM PO went to Roby’s residence to inquire about the incident. Contact was made with Roby who admitted that he had been both at Aldi and Rural King at the time of the incident as well as confirming that the incident had occurred. Roby stated that he had told Odin “you’re lucky you’re not older because I would kick your fucking ass”. The footage from cruiser 1931 while speaking with Roby at his residence was burned to a DVD and placed into property as evidence. Roby was cited for menacing and served his copy of the citation as well as being advised of his mandatory court date.

Theft

On 12/11/23 at 7:21 AM police was dispatched to 220 Riffle Avenue in reference to a theft from a vehicle. The complainant, David Harsh advised he drives a work truck, owned by Moeller door and window. David advised he parks his vehicle on the street in front of his residence. David stated he parked the truck on 12/8/23 after work and didn’t go back out to it on this date and time. David stated when he went out to the truck to leave for work he noticed a side door on the tool box compartment was open. David advised he noticed a bandsaw was missing from this compartment. He stated he also had a sawzall missing. David advised the compartment lock does not work, but knows that it was shut when he parked the vehicle on 12/8/23. David stated he does have cameras but they do not point towards the truck. David sent PO video footage of an unknown subject walking in the alley by his residence and onto the sidewalk near where the truck is parked. The video will be included with this report. David completed a written statement form for this report also. David stated the owners of the property are aware and asked for a report to send to insurance. PO advised David that he needed serial numbers for the items stolen and he is yet to give PO the serial numbers.

Forgery

On December 10th, 2023 PO was requested to make contact with Tim Bigham who is the Senior Vice President of Mercer Savings Bank, in reference to a forged check. PO made contact with Tim who advised that on December 4th, 2023 a male subject by the name of Clayton Dawes cashed multiple forged checks at several different Mercer County Bank locations. The first check to have been cashed on this date was at the Greenville Mercer Savings Bank branch, located at 125 E. Main Street, in the City of Greenville. This check was in the amount of $3,769.31. Tim stated Dawes then went to two other locations, not in this jurisdiction, and cashed two more forged checks. On the attempt of the fourth forged check, at a Celina branch location, authorities were contacted and Dawes was arrested. Dawes admitted to Celina officers that he was given the checks to cash and was suppose to give the money to a subject in Dayton when he was done. Dawes had no money on him at the time of his arrest. Tim provided PO with a copy of the forged check that included a photo copy of the Ohio Identification card provided by Dawes at the time the check was cashed. The Identification card identified him as Clayton Wayne Dawes, date of birth 08/30/1978. The forged check was from the account of Mendon First Church of God, made payable to Clayton Dawes, and signed by Kristina Boroff. Tim also provided PO with an affidavit signed by Kristina Boroff stating the check cashed at the Greenville Mercer Savings Bank was a forged document. charges for the forged check cashed in Greenville. Tim advised he wished to pursue. Tim Burns, manager of the Greenville Mercer Savings Bank, provided PO with video of Dawes in the Greenville branch. The male subject is wearing a tan ball cap that made it hard to see his face. He can be seen providing the Ohio Identification card to the teller that is then photo copied, and later provided to PO. PO observed the subject in the video to be wearing a flannel type button up shirt with red and black markings. PO checked the Mercer County Jail inmate roster and observed the mugshot of Clayton Dawes taken on December 4th, 2023 when he was arrested in Celina for forgery. PO found Clayton to be wearing the same flannel button up type of shirt as what was being worn in the Greenville Mercer Savings Bank video footage from the same date. This case will be forwarded to the Prosecutor’s Office for a review of charges.

Shoplifting

On December 15, 2023 at approximately 4:16 PM police responded to 1501 Wagner Avenue reference a shoplifting complaint. PO made contact with employee Jodi Edger, and the suspect, Kaylee Hines in the loss prevention office. Jodi stated that staff noticed Kaylee walking around the store placing several miscellaneous jewelry items as well as miscellaneous baby items in her cart. Jodi stated that Kaylee then selected a lunch box from the shelf and placed everything that was in her cart into the lunch box. Jodi also stated that staff observed Kaylee placing items into her pockets as well. Jodi stated that Kaylee then took the lunch box with the miscellaneous items as well as the items that were in her pocket and walked out of the front door without paying for them. Kaylee passed all points of sale and was stopped on the sidewalk outside the store. Jodi also stated that they believed Kaylee still had items in her pocket that were stolen. Jodi filled out a written statement and a victims rights form. PO then spoke to Kaylee. Kaylee was passive aggressive and would not answer any questions the first time they were asked. Kaylee had a puffy jacket on and PO observed the pockets to be full of merchandise. PO located additional finger painting supplies in her pockets. Kaylee did not make any admissions. Kaylee was issued a citation for theft as well as warned for trespassing. Kaylee was then released. In total Kaylee stole 32 items, totaling $232.24. The items included 10 bottles of finger paint, 2 shampoos, 2 eye liners, 5 necklaces, a lunch box, a bag of plastic bags, pacifiers and baby clothes. All of the items were returned to Walmart. Photos of the stolen items will be attached to this report as well as video from Walmart.

Animal Problem

On December 15th, 2023, at approximately 4:22 PM police was dispatched to the 100 block of Virginia Avenue. This was in reference to a complaint of a dog at large. The complainant advised that the resident of 127 Virginia Avenue was not able to control his dog and it was off the property unsupervised. PO arrived on scene at 4:42 PM and activated the cruiser camera. While east bound in the 100 block of Virginia Avenue PO observed a female holding onto the collar of a brown K9 and walking through the yard of 123 Virginia Avenue. The female was walking towards 127 Virginia Avenue and took the dog inside. PO made contact to a male resident, Spencer Kouts. PO asked Spencer if he resided at 127 Vrignia Avenue and he advised yes. PO also asked Spencer if the dog that was out running loose was his. Spencer advised yes the K9 was his and his child accidentally let the dog out because the front screen door doesn’t latch all the way. Spencer also admitted that the K9 was registered to him. Spencer admitted that the female holding the dog was, Kylee Holbrook, his girlfriend. On September 13th, 2023, Spencer was cited reference failure to control dog. Spencer was convicted in Darke County Municipal Court on 09/26/2023 and Case #23-CRB-001-0405. Spencer was issued another citation reference Failure to Control Dog, which was enhanced to Fourth Degree Misdemeanor reference previous conviction. Spencer was issued a copy of his citation and admitted to the offense.

Menacing/Domestic Violence

On December 15, 2023 at approximately 10:42 PM police responded to 830 Dorothy Lane reference a possible domestic dispute. PO made contact with Kelly Lewber and Alicia Martinez. Both subjects stated that Alicia’s estranged husband, Joe Martinez came to the house and was banging on the door prior to PO’s arrival. Both subjects stated that Joe left before PO got there. Alicia stated that she has been separated from Joe since October of this year and has been living in Arcanum without him. Alicia stated that on todays date while she was still in Arcanum, Joe began to call her continuously. Alicia stated that she answered so that he would stop. Alicia stated that while on the phone, Joe accused her of cheating on him and stated that he was on his way to her house and was going to shoot whoever she was with. Alicia stated that Joe did come to the house and began banging on the door. Alicia stated that she did let him in so that he would stop. Alicia stated that after he left, she called Kelly and asked her if she could come over. Alicia stated that on her way over she stopped and the Dollar store in Arcanum, but had not told Joe she was there. Alicia stated that Joe then texted her telling her that he knew that she was there. Alicia then went to the gas station and Joe messaged her again letting her know where she was. Alicia stated that she then came to the above listed address, which is where Kelly lives. Alicia stated that she also did not tell Joe where she was going. Alicia stated that this is when Joe showed up and began knocking on the door. Alicia stated that she was in fear for her safety because of Joe’s behavior. PO then looked at the underneath of Alicia’s car and located a black tracking device that was placed under the rear bumper. Alicia stated that it was not hers and did not know that it was there. The tracker was taken and placed into property. The tracking device is “Tracki” brand and can be purchased on amazon. The device is subscription based and can provide real time updates of the devices location through the companies app. Alicia filled out a written statement. A Sgt spoke to Joe over the phone, but he did not admit to placing the device on the car. Joe and Alicia are still married.

DUI

On December 16th, 2023, at approximately 11:47 PM police was dispatched to 1120 Russ Road, Taco Bell, in reference to a traffic offense complaint. The complainant advised that the vehicle, Silver Jeep, in line of Taco Bell did not have it’s headlights on while driving on the roadway. The vehicle was also swerving all over the roadway before arriving at Taco Bell. PO arrived to the area and immediately observed a 2019 Silver Jeep Cherokee being operated south bound on Wagner Avenue at Russ Road. The vehicle did not have any headlights illuminated to the front of the vehicle at 11:50 hours, while it was dark outside. The vehicle then turned west bound onto Russ Road from Wagner Avenue. While making the turn the vehicle failed to stay to the right side of the roadway and crossed the double yellow line. PO followed the vehicle for several blocks and it still did not have any headlights illuminated. A traffic stop was made on the listed vehicle on Russ Road near Sugarmaple Drive. While the vehicle was pulling over to the side of the road both passenger side tires went up onto the curb. PO approached the vehicle and confirmed the operator of the vehicle to be Lauren Blocher. While speaking to Lauren PO could smell an odor of an alcoholic beverage on her breath. Lauren’s eyes were also blood shot and glossy, and PO observed an open alcoholic beverage in the center cup holder. PO asked Lauren how much she had to drink tonight and she advised just two beers. PO asked her to hand him the alcoholic beverage which was about half full. The beverage was dumped out and disposed of. The alcoholic beverage was a 12 ounce Simply Peach. Due to the driving behavior and the indicators of alcohol consumption PO asked Laurent to exit the vehicle to perform a set of standardized field tests and Lauren refused. Once Lauren refused to perform the SFST’s she was asked to exit the vehicle to be placed under arrest for operating under the influence. Lauren exited the vehicle and was placed into handcuffs. Lauren was mirandized and placed into the rear of the cruiser. Lauren’s vehicle was picked up by a valid driver. Lauren was transported to the Greenville Police Department where she was read the BMV 2255 form. Lauren consented to a chemical breath test. The results of the tests showed Lauren’s BAC had a concentration of eighteen-hundredths of one gram or more by weight of alcohol per two hundred ten liters of the person’s breath. Laurens BAC was.181 % and she was placed under an administrative license suspension. Lauren was also issued a copy of her citation, copy of her test results, and a copy of the BMV 2255 form. Lauren was also issued warnings for the headlights and lanes of travel. Lauren was released to a valid, sober driver.
