Subject with Weapon

On February 27th, 2024 at approximately 9:16 AM police was Dispatched to the 1300 Block of Wagner Avenue in reference to a traffic offense. The anonymous caller advised that James Bush was driving a tan older chevrolet malibu. The caller advised James was possibly intoxicated and has a firearm in the vehicle. PO observed a vehicle matching that description in the parking lot of 1301 Wagner Avenue, McDonalds north. PO parked my cruiser behind the vehicle, PO observed the driver later identified as, James Bush standing outside of the vehicle beside the driver’s side door. PO advised James that police had received a report that he was driving intoxicated and had a firearm in the car. James stated that he was not intoxicated and did not do anything wrong. James told the passenger of the vehicle later identified as, Bryan Roth, to lock the vehicle doors. PO asked James if there was any weapons in the vehicle. James stated the car was not his and he did not know if there was any weapons in the vehicle. While speaking to James, other police and Darke County Deputies arrived on scene. Dispatch advised James’s driving privileges are under a Non-Compliance suspension from 07/08/2022 to Indefinite. PO asked James if he drove to McDonald’s. James advised he did not. PO asked James how he got the vehicle to the parking lot. James advised his cousin dropped them off and left. PO went into McDonald’s and spoke with the manager about seeing the video footage of the vehicle driving into the parking lot. The manager showed PO the video of the malibu pulling into the parking lot, PO could see James drive the vehicle into a parking lot and exit the vehicle. The manager advised she would put the video footage onto a hard drive and bring it to the Greenville Police Department. After speaking to the manager, PO went back outside. A deputy walked his K-9 around the vehicle. Deputy advised PO that his K-9 had positively alerted to the vehicle. PO asked James where the keys to the vehicle were because police now has probable cause to search the vehicle. James advised he did not know where the keys were. A Captain advised Darke County Dispatchers to contact the registered owner of the vehicle to ask him respond with a key. The registered owner of the vehicle advised he would respond to the scene. PO conducted a search of James’s pockets. James advised PO he had a needle in his left front pocket. PO pulled the needle out and asked James what the needle was used for. James advised he uses the needle for Methamphetamine. After searching James, the registered owner of the vehicle arrived on scene and provided PO with the keys to the vehicle. PO conducted a search of the vehicle. PO located a Smith and Wesson. 40 caliber pistol underneath the driver’s seat, where James was sitting. James was the only person in the vehicle that had access to the firearm. A Deputy located a small bag containing what appeared to be Methamphetamine in between the driver’s seat and the center console, also where James was sitting. PO asked James if the bag that contained what appeared to be Methamphetamine was his. James advised he did not know that the Methamphetamine was in the car. PO asked Bryan if he knew anything about the bag containing what appeared to be Methamphetamine that was located near the driver’s seat. Bryan advised he did not know anything about the Methamphetamine. James has been convicted of Trafficking of Drugs on June 16th, 2020 which makes it illegal for James to be in possession of a firearm. PO placed James in handcuffs and placed him in the back seat of the cruiser. PO transported James to the Darke County Jail for Weapons Under Disability, Possession Of Drugs and Driving Under Suspension. James was released to Jail Staff. After transporting James to the Darke County Jail, PO returned to the Greenville Police Department. Police field tested the contents of the bag that was located in between the driver’s seat and the center console. The contents of the bag tested positive for Methamphetamine. The bag and its contents are being sent to the Ohio Crime Lab for further analysis. A Det. tested the firearm that was located in the vehicle and found that it was operable.

Menacing

On February 27, 2024 at approximately 3:36PM police responded to 309 Bucoba St. in reference to a menacing complaint. PO made contact with Joseph Mogle and Glenn Mitchell, who are room-mates and live together at this address. Both parties stated they were in a verbal argument with conflicting stories. PO first spoke with Glenn who advised he was on the phone with, defense attorney, David Rohrer, when Joseph began yelling at him. Glenn stated he and David were discussing the eviction process, and that David stated he would meet with him on Friday to discuss evicting Joseph from the property. Glenn advised that once Joseph heard the word “eviction” he began yelling and threatening both Glenn and David and yelling for Glenn to call the police. PO then spoke with Joseph who stated the argument was started by Glenn over Joseph using the front door. Joseph stated he was attempting to walk out the front door of the residence when Glenn began yelling at him to use the back door. Joseph told Glenn, “I live here and have just as much rights as you.” Joseph left the residence on foot and came back shortly after and observed Glenn on the phone with David Rohrer discussing eviction. Joseph advised Glenn then stated, “We need to get this motherfucker out of my house… I will stab you and kill you and go to prison for life, I don’t care.” Joseph stated he then called dispatch. PO spoke with David Rohrer over the phone. David stated during his phone conversation with Glenn during the altercation, he could hear yelling in the background. David stated he could not make out any direct threats. Both subjects filled out written statements. Due to the conflicting stories there will not be any charges.

Assault

On 02-27-24 at approx. 4:12 PM police was dispatched to 141 Terrace Creek Drive on an assault. PO observed a male, who was later identified as Brian Swabb, to be on the ground. PO asked witnesses what had happened, these three witnesses were able to write out statements as to what took place. The three witnesses are, Ruwena Shoda, Blain Swabb, Lori Slater and the victim Brian Swabb. Brain Swabb also completed the victim rights form. Ruwena said that she heard yelling outside, When she went out to see what was happening she observed four people yelling at each other over two dogs that had been loose. She stated that Brian had a stick by his side as the two males got close each other, Ruwena told the males to not get into a fight when Brian turned away from the other male. The other male was identified as David Pole. Once Brian turned away from David they turned back around to face each other; this is when David punched Brian knocking him to the ground. All three witnesses stated in their statements that Brian and David had been yelling back and fourth with each other but Brian made no threat of striking anyone with the stick. It was brought up in the statements that David called Brian a “dumbass” when he turned around causing Brian to turn back around, walk toward David and say “no, you’re the dumb ass.” Brian said the only reason he had the stick was to protect him and the others from the two dogs that had been loose. Both dogs were trying to attack his cat. Brian remembers calling David a dumbass but can’t remember anything after that. Photos were taken of Brian’s injuries and documented in the report. Officers went to 1019 E Fourth Street to speak with David Pole and two other witnesses who were identified as Preston Gahret and Cinsearay “Lizzy” Gahret. While speaking with David he states that the dogs got loose and they went looking for them. He said he heard yelling and went into the backyard to see a man (Brian Swabb) going toward Lizzy with a stick. David said he yelled at Brian to put the stick down, when Brian started to scream in his face stating he was going to hit the dogs. David said he asked them to help with the dogs and he was told “fuck you,” Brian then stepped onto their property trying to hit David so he threw a punch. David said Brian fell onto the ground so he then walked back to his house. Both witnesses Lizzy and Preston Gahret stated the same in their witness statements. Brian had came up to them acting like he was going to hit the dogs and Lizzy. When David arrived, he and Brian got into each others face when they both believed Brian was trying to hit David with a stick so David then punched him. David Pole was charged with Assault and Brian Swabb was charged with Disorderly Conduct.

Theft/Forgery

On February 28th, 2024 at approximately 10:07 AM police was dispatched to 1359 Sater Street in reference to a Forgery. PO made contact with an employee of Falcon Packaging, Stephanie Hubbard. Stephanie advised the company had paid $36,784 online to Badger Paperboard through a vendor, ACH. Stephanie advised she paid ACH with two separate checks. The first check was for $18,392 on December 30th, 2023 and the second check was for $18,392 on January 9th, 2024. The vendor was to pay Badger Paperboard for packaging supplies. Stephanie stated the company always uses this vendor. Stephanie advised she paid Badger Paperboard through ACH to an email address. Stephanie advised the email address is familiar to Falcon Packaging and they have paid Badger using this email in the past. Stephanie advised the Falcon Packaging received emails from Badger Paperboard inquiring why Falcon had not paid them for the packaging supplies. Stephanie advised Badger Paperboard she had paid them. Stephanie advised she spoke with Badger Paperboard and they advised her they have other customers report the same issue in the past. Badger Paperboard advised Stephanie the Email address she had ACH pay is valid. Badger Paperboard advised Stephanie that their emails have been hacked in the past and they believe that is what happened again. Stephanie gave PO all the invoices for the payments. The invoices showed the money was paid to a J.P. Morgan account in Georgia. Stephanie advised Falcon Packaging has their email addresses hacked in the past as well. Stephanie advised when Falcon’s email addresses were hacked their IT specialist attempted to track the domain back to Iceland. Falcons IT specialist advised PO the domain tracking may not be accurate. Stephanie advised she needed a police report for her bank so the bank can refund their money. PO collected a statement from Stephanie. After speaking to Stephanie, PO made contact an IT specialist from Badger Paperboard, Jeff. Jeff advised Falcon packaging does not buy from them. Jeff advised he has had no record of their accounts being hacked. Jeff advised he would not give PO any information because he could not verify that PO is a Police Officer. Jeff advised he would look into the incident and call PO back. Shortly after speaking to Jeff he called me back. Jeff advised that the correct email for Michelle would be without the “S” at the end. Jeff believes someone used Michelle’s name and added the “S” to deceive customers into believing they were speaking to the correct person. Jeff advised Badger Paperboard does not bank through J.P. Morgan. Jeff advised he found that another customer had received an email like this in the past but verified with the company before they paid them.

Traffic Stop

On February 28, 2024 at approximately 2:59 PM, police observed a silver Ford Edge bearing Ohio registration JSN8956 traveling south on Walnut St. After checking the registration through LEADS/NCIC, PO discovered the registration was expired as of September 4, 2023, and that the registered owner’s Ohio driving privileges were under a non-compliance suspension from 05/05/2023 to 05/05/2024 with an FRA. PO initiated a traffic stop of the vehicle on Walnut St. near East Third St. and made contact with the driver/defendant Jeffery Franklin who is also the registered owner. Dispatch confirmed the defendant’s Ohio license was suspended through LEADS and registration was expired as of 09/04/2023. Due to this being Jeffery’s third DUS and expired registration citation since 10/06/2023 (10/06/2023 and 02/02/2024), and his suspension being FRA, the vehicle was towed by Hurds to their impound lot. Photos were taken and an inventory was done. The defendant was issued a copy of this citation and advised of his court date-time.

Harassment

On 02-28-24 police spoke with a subject in the lobby in reference to telecommunication harassment. PO spoke with Cynthia Horne in reference to Larry Bingham calling her multiple times leaving her harassing voicemails. Cynthia said this has been going on for a while now and she wants it to end. She showed PO her phone where she has blocked multiple numbers that Larry uses. She also showed PO the new number. Once PO called this number Larry answered. Larry stated he didn’t call her but PO advised him he had listened to the voicemails and they needed to stop. PO issued Larry a warning for telecommunications harassment.

Disorderly Conduct

On February 29, 2024 at approximately 7:07 PM police was dispatched to the 700 Block of Washington Avenue in reference to a suspicious person. PO observed involved person, Robert Gorrell, standing in the street and it appeared he was searching for something. When talking with Robert he seemed to be having difficulty concentrating as well as acting paranoid. While attempting to locate someone that could look after Robert he began stating that he observed things that were not there and began acting erratically. An ambulance was requested to the scene to check Robert’s health due to his behavior. While waiting for the ambulance to arrive on scene Robert began acting more erratically and started to yell about objects that were not there. Robert began running and jumping around not listening to verbal commands that were issued to him. While Robert was running he tripped and fell to the ground at which point PO detained him by placing him into handcuffs so that he could be evaluated by Greenville Rescue. While being examined by Greenville Rescue Robert stated that he had used Methamphetamine, Cocaine, and Acid. Greenville Rescue administered 2 doses of Ketamine in order to calm him down but it was not effective. Robert was taken to Wayne Emergency Room by Greenville Rescue for medical treatment. During the time Robert was detained while he was receiving medical treatment he continued struggling against the handcuffs which caused visible injuries to his wrists. Robert is on Federal Probation and a message was left for his probation officer to inform her of the incident. At this time no further follow up is needed.

Wanted Person/Fugitive from Justice

On February 29th 2024 at 9:43 hours, a known wanted subject was apprehended at 1135 Howard Drive Greenville OH 45331. PO made contact with Mark Barberine who was known to have a felony warrant. Dispatch confirmed through LEADS/NCIC that Mark had a felony warrant with no bond out of Miami County for passing bad checks. Mark was placed in handcuffs. The warrant was confirmed by Miami County Sheriff’s Office. PO transported Mark to Miami County and Darke County line where he was released to Miami County.
