Drugs
On February 15th, 2024, at approximately 5:47 PM police observed a male subject operating a bicycle west bound on Walker Street near Washington Avenue. PO observed the bicycle being operated in the middle of the roadway and also observed the bicycle did not make a complete stop at a clearly visible stop sign. A traffic stop was made on the listed vehicle and the operator was confirmed to be Joseph Braun. PO advised Joseph for the reason he was being stopped and asked for his identification. PO then asked Joseph where he was coming from and he advised the Family Dollar. It would be possible for Joseph to be coming from the Family Dollar but seems unlikely that was where he just left reference where PO located him and where he was traveling. So PO asked Joseph if he could search his person and if it was okay then please step off the bicycle. Joseph let PO search his person and in a cigarette container that was located in his shirt pocket PO located a baggy of an unknown substance. When asked about the substance, Joseph advised the substance was cocaine. Joseph was released and advised of the court procedure. The unknown substance was transported to the Greenville Police Department and placed into evidence. This case will be presented to the Darke County Grand Jury pending lab results.
Theft
On December 5, 2023 police received an email from the complainant/victim, Jeffrey Porter, who stated that in October of 2021 he had ten (10), 2014 -2017 Ez-Go TXT golf cart bodies taken to Barberine’s Custom Works LLC, 1210 Sweitzer St. to have them repaired and painted. The ten bodies was suppose to make seven (7) complete bodies. Porter explained in his email that he gave owner, Mark Barberine, a cash deposit of $2,100. Porter received a written receipt for the deposit, which originally showed $1,200. The receipt was corrected and initialed by Barberine to reflect the correct amount of $2,100. Supporting correspondences through text messages support this. On January 23, 2022 Porter reached out to Barberine and asked if he could pick up some of the golf cart bodies on January 28, 2022. Barberine stated “Yes. Absolutely”. When Porter advised Barberine he was about a half hour away, Barberine informed him that he closed his office because he had to get his wife home due to her being sick. On February 21, 2022 Porter reached out to Barberine and asked if he could pick up the golf carts, Barberine stated “No not today, I’ll get with you tomorrow and set an actual day and time”. On March 29, 2022 Porter reached out to Barberine again, asking “how’s the process coming along” There was no reply from Barberine. On April 7, 2022 Porter sent Barberine a text message stating he wanted his money back since it had been almost eight (8) months without any work. Barberine replied stating “I have done work to all the bodies” Barberine claimed he had been building his “golf cart and motorcycle specific paint booth” Barberine explained he used all the money towards this and material, and that he hired a tech to handle the golf carts for the season. Barberine advised Porter “I will have these carts completed for you next week, no excuses”. On April 11, 2022 Porter informed Barberine that he would be there on Friday, April 15, 2022 to pick up the carts. Barberine responded with an “ok” hand emoji. On April 15, 2022 Porter reached out to Barberine and informed him that he would be there around 3: 00 to pick up the golf carts. Barberine responded with” Oh shoot. I forgot this was gonna be a short week with good Friday and Easter. We are closed today and Monday and off to visit with family and have personal time. Took an extended weekend. When can you come Tuesday or after? Dang, I’m sorry!” Porter then asked Barberine if they were done. Barberine responded with “I do wanna buff and inspect but all you have to do is pick them up”. Porter informed Barberine he would be there Tuesday at 3:00. Barberine acknowledged with “Ok thanks! Enjoy your Easter holiday!” On April 18, 2022 Porter texted Barberine to inform him that he had to change the pick up date to Friday April 22, 2022. Barberine never responded. On April 21, 2022 Porter reached out again asking if that was ok. Again Barberine never responded to Porter text message. On April 22, 2022 Barberine texted Porter in the morning claiming he had just seen his messages and that he could not pick up because he was out for camping fun. On June 9, 2022 Barberine informed Porter that he would estimate completion of the golf carts before June 24, 2022. On June 27, 2022 Porter asked Barberine “How are we doing?” Barberine replied the following day on June 28, 2022 stated he had to go to Florida last minute where his dad and brother live, and that the shop would be closed till July 6, 2022. And that he would finish him up that week. On July 8, 2022 Porter texted Barberine asking if there was any progress. Barberine never replied to his text message. On July 10, 2022 Porter sent Barberine a text stated “263 days since I paid you”. Barberine replied stating “Well that does seem like quite a while. We were involved in a collision ourselves. And so delay getting into the shop and back on track. But the good news is I hired two experienced technicians, both start Monday”. On August 1, 2022 Porter texted Barberine asking how the progress was coming along. Barberine never replied to the text. On November 10, 2022 Porter again reached out to Barberine stating” 384 days Mark!” Barberine again, never responded to the text message. As of February 20, 2024 Barberine has failed to finish the golf cart bodies or return them to Porter. Barberine has knowingly deprived Porter of both his property as well as the services he paid for. Felony charges of Theft by Deception were submitted on February 26, 2024.
Theft
On February 7, 2024 PO received an email from the complainant/victim, Josh Chaney, who stated that on January 6, 2024 he received a Facebook message from Mark Barberine of BCW Sales. Barberine advised he owned a shop in Dayton, but lived in Greenville and informed Chaney he could use his services in the future. It was learned Chaney does automotive pinstriping. Barberine then asked if Chaney needed any repairs or custom paintwork done. Chaney stated he had a motorcycle he’d like to have painted. Barberine said he could do it and was looking to secure a job ASAP. Barberine quoted Chaney $2,500 and requested a $1,000 dollar down payment that day or the following. On January 7, 2024 Barberine met at Chaney’s residence, 220 Central Ave. Barberine had a prepared, hand written contract he wanted signed, and took $400 cash from Chaney. It was agreed that Barberine would pick up $600 on January 8, 2024, to complete the $1,000 down payment. Barberine was suppose to pick up the motorcycle the following week, if not before. On January 25, 2024 Chaney reached out to Barberine stating he hadn’t heard from him since the deposit was made and wanted to cancel the job and get a refund. Barberine replied stating due to the rain and cold temperatures outside he didn’t think he should trailer it out of the garage. Chaney informed Barberine that he learned of his reputation and began reading reviews and began seeing the same pattern with his job and explained to Barberine that it was best to cancel the job and get his money back. Barberine replied in his message that they are moving forward with the job since he had already invested the deposit on product, time inspecting, doing an estimate, along with design and thought. Barberine talked Chaney into letting his get the bike the following week. On January 31, 2024 Barberine told Chaney that Sandy’s towing is going to be picking his motorcycle up. Chaney asked Barberine for the address the motorcycle was going to and Barberine informed him that it would appear on the tow receipt instead of just telling him. There was no contact from Sandy’s Towing. On February 8, 2024 Barberine contacted Chaney stating that Sandy’s Towing had tried to reach him multiple times. Chaney stated he had one missed call from Sandy’s and that was at 8:15 in the morning on February 8th, 2024. Chaney advised Barberine that it had been a month since his deposit and nothing was getting done so he wasn’t comfortable with following through on the job and again requested his money back. Barberine agreed to cancel the job and told Chaney that he would make payments to repay his deposit, however, no payments have been received. Chaney completed a voluntary statement and supplied screen shot messages supporting his statement. Felony theft charges have been filed against Barberine for theft by deception under Ohio Revised Code 2913.02 ( A)(3).
Domestic Violence
On February 26th, 2024 at approximately 12:41 PM police responded to 415 Martin Street in reference to a Domestic Violence. PO made contact with Jenna Horne and her mother, Cynthia Horne. Jenna stated she came to the residence to pick up items from her husband’s residence, Dustin Burk. Jenna advised they are in the process of getting a divorce. Jenna stated she she does not currently live at the residence anymore but she is on the lease. Jenna advised she went to the front door of the residence and knocked. Jenna advised when Dustin answered the door they began to argue. Jenna advised Dustin would not allow her to pick up her belongings. Jenna stated Dustin had a knife in his hand opening a cardboard box. Jenna stated she went down the stairs when Dustin stood at the front door and began to rip a book apart. Jenna stated Dustin threw the book down the stairs and it struck her in the head. PO did not see any marks on Jenna’s head. Cynthia advised she witnessed the whole incident. After speaking to Jenna and Cynthia, PO went upstairs and made contact with Dustin and his friend, Kadyn Edwards. Dustin advised he was sitting on his couch setting up his Xbox when Jenna and Cynthia arrived at his front door. Dustin advised after he opened his front door, he began arguing with Jenna and Cynthia. Dustin advised Jenna began to threaten to have him “Jumped” by someone named “Chris”. Dustin advised Jenna went down the stairs. Dustin advised he ripped up a book that she had left in the residence and threw it down the stairs. Dustin advised he did not throw the book at Jenna. Kadyn advised he witnessed the whole incident. Kadyn advised he did not see Dustin throw the book. Kadyn advised Jenna claimed the book hit her in the foot but told me that the book hit her in the head. PO collected a statement from Dustin and Kadyn. After speaking to Dustin and Kadyn, Jenna came up to the residence to get the rest of her belongings. PO asked Jenna if she threatened to have Dustin jumped. Jenna advised she may have said “Dont be surprised if you get jumped”. Cynthia showed PO a recording of Dustin stating “I will Kill You Bitch” to Jenna. The recording was audio only. PO collected a statement from Jenna and Cynthia. All parties left the residence. After PO left the residence, jhe spoke with Prosecutor, Deb Quigley about the incident. Deb advised PO that both parties were in violation of the Ohio Revised Code Domestic Violence threats section and could be issued a citation. After speaking to Deb, PO went to Jenna’s residence and issued her a citation for Domestic Violence threats. After speaking to Jenna, PO returned to Dustin’s residence to attempt to make contact with him. PO was unable to make contact with Dustin at his residence.
Breaking and Entering
On February 26, 2024, at approximately 1:10 PM police was dispatched to 426 Union Street in reference to a report of a male subject Breaking and Entering into a camper. Police was able to speak with the complainant/victim, Scot Ross. Scot advised that he was working out when he observed noise coming from the camper parked in the car port area of his detached garage located on the north side of his property. Police was able to go to the area where they located the camper. PO was able to make contact with a male that was inside the camper. The male was later identified as the defendant. The defendant was given verbal commands to come out of the camper but did not comply. Scot advised that he did not give anyone permission to enter or to stay inside the camper. Police contacted Darke County Sheriff’s office in reference to having a Sgt and his K9 partner assist with getting the male out of the camper. While waiting, the defendant, was advised to exit the camper or the K9 would be coming in to assist him outside. The defendant then complied. The defendant was able to exit the camper at which time he was ordered to the ground. The defendant was then placed in handcuffs and was searched incident to arrest without any contraband being located. When asked, the defendant stated that he had gotten in the camper by entering the car port area of the garage then climbing up the utility ladder located on the back of the camper. He advised that he then got on the top of the camper and entered through a vent opening on the top of the camper. After investigation it was found that the defendant had damaged the vent covering in order to enter the camper. The defendant was advised of his Miranda Rights and placed into the back of a cruiser. He was then transported to Darke County Jail where he is being incarcerated for Criminal damaging and Breaking and Entering. He is being held with no bond. Scot was given and completed a witness statement form that will be completed and turned into Greenville PD.
Theft
On February 8, 2023 police received an email from the complainant/victim, Cory Sager, who stated that on May 24, 2021 he took his 1968 Pontiac Catalina to Barberine’s Custom Works LLC, 1210 Sweitzer St. to have them repaired the trunk pan. A $400 deposit was paid to owner, Mark Barberine at the time of drop off, in which a receipt was provided. On June 1, 2021 Sager returned to Barberine’s and paid another $600 cash towards his repairs. In February of 2022, 9 months after making his $1,000 deposit, Sager reached out to Barberine since he hadn’t heard from him regarding his trunk repair. Sager and Barberine set up a meeting for February 21, 2022. On the morning of the meeting Sager received a text message from Barberine stating he would like another $2,000 and that the whole car was stripped of paint from one end to the other and that all the trim and hardware had been removed. According to Sager, this was not what Barberine was suppose to do. He was only to replace the trunk pan. After finding out that Barberine sanded his car down without his permission Sager felt he had no choice but to follow through with the paint that Barberine promised him he’d do, so he paid $2,000 in cash towards Barberine’s quoted $7,125.22 to finish the car. On May 20, 2022 Sager received a text message from Barberine advising him that he accidentally charged his credit card $2,400. Upon finding this out Sager looked at his account and found that Barberine had charged his card for $1,200 on two separate transactions. Barberine never tried to reverse or refund the money he charged without Sager’s authorization. Sager had to dispute the charges through his bank, who eventually credited his account. On March 21, 2023 Sager received a text from Barberine informing him that he was moving shops to a spot near Huber Heights/Tipp City area. After the move Sager tried contacting Barberine in attempts to see his vehicle at the new shop, but Barberine would not respond to him so he came to the Greenville Police Department regarding his concerns. An officer took Sager to Barberine’s residence where they made contact with his wife who in turn called Barberine. A date and time was arranged for Sager to pick up his vehicle which was being stored in an enclosed trailer. Barberine never completed the work Sager gave him money to do, never refunded him his deposit, and returned Sagers vehicle in worse shape then he received it in. This case was submitted to the Darke County Prosecutors Office for one count of Felony Theft by Deception under Ohio Revised Code Section 2913. 02( A)(3), and 2 counts of Felony Misuse of a credit card under Ohio Code Section 2913.2l(B)(2).
