Theft

On March 11, 2024, police received an email from DeRhonda McNally advising that she had been involved in a car accident on Wagner Ave. in September of 2022 and had went to Barberine’s Custom Works LLC, to get an estimate on the repairs. According to McNally, her husband, Joseph McNally, signed a paper allowing Mark Barberine to do the repairs. According to DeRhonda, Barberine was suppose to provide an estimate to them before proceeding forward. Approximately a week later DeRhonda and Joseph met with Barberine to go over the estimate that she had never received. During this time they noticed discovered that Barberine had already started an insurance claim, in which several items were left off the estimate. DeRhonda advised she questioned Barberine about the missing items on the estimate and was told it was to ensure a second claim against the insurance company, stating that he could bill them several thousand more dollars. At this time the McNally’s decided they weren’t going to have their vehicle repaired at Barberine’s shop since it was not there for repairs yet. A few days later the McNally’s received a check in the mail from Dairyland Insurance for the amount of $3,711.26, which they took to their bank and deposited. The check had a’ stop payment’ ordered on it at which point DeRhonda contacted the insurance adjuster, David Knetter. Knetter advised Barberine had sent in a contract and pay order so they stopped payment on the check and re-issued payment to Barberine. On October 12, 2022, DeRhonda informed Knetter of Barberine’s intent to over charge the insurance company and file additional claims. The re-issued check to Barberine the had a “stop payment’ on it from Dairyland. On November 2, 2022, after finding out that the check had been stopped Barberine contacted McNally’s demanding the check be re-issued along with the following: “Mr. McNally, sorry for the early text. But this communication is very important. I have been waiting for you to either call to schedule your car for the repairs and ask that I have the rental set up, or to just drop it off. I noticed this morning, that yesterday, my bank showed that the insurance company put stop pay on the check I received. I presume that would be by your direction. May I remind you, that you signed a contract for me to repair your vehicle. Most importantly it stated that should you receive any check/cash/draft/ or payment otherwise, you have 24 hours to turn it over to me. It is legally binding and may actually constitute fraudulent activity and/ or theft. At the very least, if you do not turn over the payment and follow through with our shop performing repairs, I will have no other choice but to pursue other actions. I have invested a great amount of time (documented in detail) in the initializing and approval of this claim, on your behalf, to make your car whole again, already. Also note, I have documentation to back all this up, including your signatures, my office managers witness (as she was present), and audio/ video of the office visit and our “walk around” and damage assessment outside the office. I highly suggest you communicate with me at once to resolve amicably, and I will harbor no ill feelings whatsoever. ” McNally stated she called Knetter and advised him to not re-issue a check to Barberine, but later found out that Barberine had the check re-issued and cashed in late November 2022. Barberine never touched McNally’s vehicle other then to do an estimate on the repairs. This case was submitted to the Darke County Prosecutors Office for one count of Theft without consent under Ohio Revised Code Section 2913.02 ( A)(l), a felony of the fifth degree, and Insurance Fraud under Ohio Revised Code Section 2913.47 (B)(l), a felony of the fifth degree.
