Assault
On July 12th, 2024, at approximately 7:04 PM police was dispatched to the Greenville Police Department in reference to a subject reporting an assault. PO made contact with Jeffery Franklin and his girlfriend, Katelyn Miron. Jeffery stated he was about to leave his residence to go fishing but forgot his phone inside of his apartment. Jeffery advised he was walking back to his apartment and Darnell Hicks approached him and asked him for a cigarette. Jeffery advised he was low on cigarettes and told Darnell no. Jeffrey stated Darnell grabbed him by the throat with two hands and began to choke him. Jeffrey advised that Darnell dug his nails into the side of Jeffrey’s necks. Jeffery advised he pushed Darnell off of him and went back inside of his residence. PO asked Jeffrey if he had any injuries. Jeffery showed PO a small red scratch mark on his neck and PO did observe redness on the base of his neck. Katelyn advised she did not see the whole altercation because she was inside with her children but did see Darnell choke Jeffery. Katelyn advised she yelled at both parties to stop and Jeffery went inside. Katelyn filled out a witness statement form. PO took photographs of Jeffery’s injuries. Jeffery filled out victim’s right’ sand statement form. After speaking to Jeffery and Katelyn, police went to the Townhouse Motel to speak with Darnell. Police made contact with Darnell and his friend, Lenton Tucker. PO asked them what had happened. Darnell advised Jeffery came up to the second floor balcony where they were sitting and asked for a cigarette. Darnell stated he asked Jeffery why he wanted to come to his “table” and stated that nobody wanted Jeffery around because he beats his girlfriend and kids. Darnell advised Jeffery went downstairs and was standing in front of his residence. Darnell advised he went downstairs and asked Lenton’s wife for a cigarette. Darnell advised Jeffery yelled at him to get away from his apartment. Darnell advised Jeffrey pushed him. Darnell advised he left to go to the store at that point. Darnell denied choking Jeffery. Darnell declined to fill out a statement. After speaking to Darnell, PO asked Lenton if he saw Darnell choke Jeffery. Lenton stated Darnell did not choke Jeffery. Lenton filled out a witness statement form. A Sgt. spoke to the wife of the owner of the Town House Motel in attempt to obtain camera footage of this incident. The subject stated she did not have access to the cameras because only her husband can access them. The subject advised the Sgt. she would contact her husband and have him get in contact with the Greenville Police Department.
Domestic
On July 13, 2024 at approximately 1:08 AM police responded to 636 Gray Avenue Apartment #B in reference to a physical domestic. PO made contact with the male half, Benjamin Jones, outside sitting on the front steps. Ben had small cuts to his right arm that had been bleeding. Ben stated that he and the complainant, his live-in girlfriend Beth Stewart, were in an argument that became physical. Ben stated he had consumed approximately 3 beers prior to this incident. Ben stated the two frequently get into altercations and have been in an on and off romantic sexual relationship for approximately 10 years. Ben stated that tonight’s altercation became physical when Beth continued to get into his personal space. Ben
stated that they were in each others face multiple times. Ben stated Beth picked up a 2×4 and struck him in the arm with it. Ben stated that at this time he then grabbed the wood and pulled it away from her. Ben stated he then pushed her back with the wood but did not strike her with it. Ben also stated that Beth had thrown a stand up electric fan at him before he threw it back at her. Upon going upstairs to speak with Beth, she stated that Ben’s side of events were false. Beth stated that after their disagreement, Ben wrapped his hands around her head, pulling her hair, and stated he was going to kill her. Beth stated that she was able to break free from Ben and moved into the living room. Beth stated Ben followed her and kicked her multiple times in the right leg. Beth stated at this time, she slapped Ben with an open hand to get him to back up. Beth stated that after the slap, Ben hit her multiple times in the head with a closed
fist, and continued to pull her hair. Beth stated Ben then pulled her onto the ground. Beth stated while on the ground, she was able to grab a nearby 2X4 piece of wood and threw it at his legs. Beth stated after being hit with the wood, Ben bent down and picked up the piece. She stated Ben again pushed her down and struck her with the 2×4 on the back. Beth stated she then called the police. Due to Beth’s injuries and the wounds on Ben, which appear to be defensive from Beth, Ben was detained into handcuffs and placed into the backseat of the cruiser. Ben refused to be seen by EMS reference his injuries. Beth was then assessed by Greenville Township Rescue while on scene in reference to her injuries. Beth had swelling, redness and early possible bruising to her back as well as redness to her extremities. Beth refused to be transported by EMS for further medical evaluation. Due to Beth’s statement, Ben was advised he was now under arrest for domestic violence and read his Miranda warning, which he stated he understood. Ben was searched incident to arrest, with nothing located. Ben was then transported to the Darke County Jail where he was released to jail staff. Beth and Ben are not married but have been in an on and off romantic sexual relationship and living together for approximately 10-12 years. The two do not have children
together. Beth has been staying at the residence with Ben for approximately l year. Dispatch ran a CCH on Ben which showed no prior domestic violence convictions. Beth completed a written statement and
a victim’s rights form in reference to this incident. A statement form was left with Ben at the jail to be completed and returned. Photos were taken of both Beth and Ben’s injuries. Ben was charged with first degree misdemeanor domestic violence.
Wanted Person/Fugitive from Justice
On July 12th, 2024, at approximately 11:38 PM, Greenville Police Department dispatch received information from Brittany Hecker, who advised she could see Jesse York coming and going from his residence at 205 Cypress Street. At 2143 hours, Officers were dispatched to 205 Cypress Street in reference to a welfare check on Jesse York in regards to him sending message to Kyle Trimpi, stating he will use his rifle and 9mm gun to shoot anyone outside his house. Kyle advised dispatch that he was able to see Jesse at his residence through a window. Upon Officers arrival police made several attempts to make contact with Jesse at the front door. Jesse could be seen walking back and forth in the residence, in the upstairs window, drinking a clear bottle of liquor. Police identified Jesse by his long hair and skin, matching his jail booking photo. After several failed attempts a perimeter was set up around the residence. While on scene police received a call from McMiller’s Carry Out advising that Jesse had just made a purchase there. Officers contacted McMiller’s employee, Sabrina Shaneyfelt, who gave PO a receipt that showed Jesse, making a $160.00 purchase, one of the items being a bottle of Kamchatka vodka. The vodka bottle matched the description of the one Jesse was seen with. A PO Slade arrived on scene giving officers 360 visual of the residence to ensure no one would leave. PO contacted a Lt., who in turn, contacted a Det. to obtain a warrant to search inside the residence. Through LEADS/NCIC it was confirmed that Jesse York had an active warrant out of our agency with an original charge of domestic violence. The Lt. contacted Darke County Sheriff’s Department who would deploy Darke County SRT. Police arrived on scene at approximately 11:56 PM to help with perimeter security, which extended an entire city block. Shortly after a Cpt. (DC3) of the Darke County Sheriff’s Office, team leader of Darke County SRT arrived on scene. Police had Jesse’s neighbor, who resides at 207 Cypress Street and shares the other half of the duplex with 205 Cypress Street, evacuate his residence. After the neighbor left, a P.0. made commands from a police cruiser’s PA system to have Jesse exit the residence to which he did not comply to. When spotlights were pointed at the residence Jesse shut off all lights to the house. The Det. obtained a search warrant and later arrived on scene. He, members of the SRT, and a PO attempted to have neighbors evacuate or shelter in place for their safety. SRT made several attempts to make contact with Jesse over Facebook messenger, the messages showed that they were open but no replies. At approximately 4:43 AM SRT moved into position and set off a flash bang at the front of the residence. At 4:44 AM SRT began making announcements for Jesse to exit the residence, announcements were continually made until SRT made entrance into the residence. At 4:49 AM a foam round was deployed into an upstairs window, at 4:54 AM gas was deployed into the attic, at 4:54 AM SRT observed Jesse at the downstairs side door and gas was deployed into the second story of the residence. At 4:58 AM all windows on the second floor were compromised and filled with gas. At 5:06 AM SRT attempted to deploy gas on the first floor. At 5:10 AM movement was observed by Jesse on the second floor, and additional gas was deployed on the second floor. At 5:12 AM additional gas was deployed into the first floor. At 5:14 AM Jesse was going in and out of enclosed side porch believed to be throwing the gas out of the residence, additional rounds of gas were deployed on the first floor. At 5:15 AM more gas was deployed on the first floor. At 5:20 AM another foam round was deployed through the first-floor front window. At 5:32 AM SRT breached the front door of the residence and deployed additional gas. At 5:43 AM SRT breached the back door of the residence. At 6:00 AM SRT made entry into the residence. At 6:11 AM Jesse was located in the upstairs attic and was detained by SRT. After SRT had cleared the residence finding no other subject in the house, SRT released Jesse to Greenville Officers where his name and date of birth was confirmed. Through LEADS/NCIC dispatch confirmed Jesse’s warrant to arrest out of the Greenville Police Department for the charge of Domestic Violence. Jesse was treated on scene by Greenville Township Rescue with little to no injuries. Jesse refused any medical attention by Rescue. Jesse was then transported to Darke County Jail where he was incarcerated with no bond. Due to Jesse not responding to the multiple attempts to contact him, remaining in the residence and having to evacuate the surrounding area. Jesse was charged with inducing panic, due to causing serious public inconvenience and alarm which resulted in residents of Greenville having to leave their homes in the middle of the night for their safety. The degree of this offense enhances to a felony of the fifth degree due to the violation resulting in economic harm more than one thousand dollars. Jesse was also charged with obstructing official business which enhance to a felony of the fifth degree due to him causing risk of physical harm to persons. DUI
On July 14, 2024 at approximately 3:38 AM police observed a black golf cart traveling west on East Russ Road; without any lighted lights and illumination devices turned on. PO first observed the vehicle traveling west in the 1000 block of East Russ Road, after making a left turn out of the 1200 block of Oaktree Drive. The vehicle was traveling on the public roadway, at night, without the usage of any illumination devices. PO was headed eastbound on East Russ Road, and after the vehicle passed PO, PO made a U-turn to attempt to catch-up with the vehicle. The vehicle made another left turn and was now headed south on Sugar Maple Drive. PO initiated a traffic stop on the vehicle, on Sugar Maple Drive at East Russ Road. The vehicle failed to stop for PO’s activated lights and continued south until pulling into the driveway of 1214 Sugar Maple Drive. The driver, Danny Wayne Helm, exited the golf cart and was standing in the driveway. Upon making contact with Danny, who is also the registered owner of the vehicle, PO observed him pacing in the driveway, his speech was slurred, and had glassy and bloodshot eyes. Danny seemed incoherent due to alcohol intoxication and impairment. When asked for his driver’s license, registration, and proof of insurance, Danny had trouble locating these items. At this time, PO noticed a ‘Busch Light’ beer can sitting in the driver’s seat cupholder. Danny’s wife, Candice, then came outside to speak with police. After providing PO with his license and insurance information, Danny began holding onto the golf cart to stabilize himself. Candice stated they had just finished hosting a block party at their residence earlier in the night. At this time, PO then asked Danny if he had been drinking tonight to which he replied, “a little bit.” When questioned further about the amount of alcoholic beverages he had consumed, Danny replied with “I was just playing.” When PO addressed the beer can, Candice stated that was not his and someone had left it from the party. This can was warm to the touch and almost empty. When questioned about where he had been driving, Danny stated that the cart was parked at his residence when he decided to drive it around the block before he was planning to park it for the night. PO then asked Danny to preform a complete Series of Field Sobriety Tests (SFST’s), to which he refused. Danny was placed under arrest and into handcuffs. Danny was read his Miranda Warning, which he stated he understood. Danny was then searched incident to arrest with nothing located. At this time Danny was placed into the back of the cruiser. During this transport, Danny stated that their block party began at approximately 3PM and ended at approximately 11PM. Danny stated that after the party was over, he and Candice stayed at their residence with some of their neighbors where they continued to consume alcoholic beverages. Danny also stated that he was only drinking beer throughout the evening. PO asked Danny if he knew about how many beers he had consumed, to which he stated he did not know. PO asked Danny if he had consumed a six pack or a twelve pack to which he replied, “probably.” PO transported Danny to the Greenville Police Department where he was shown, and read, the BMV2255 form. Danny stated he understood what was read and refused a breath test. Due to Danny’s breath test refusal, his physical drivers license was seized and he was advised his driving privileges would be placed under a one year administrative license suspension ( ALS). Danny was issued a citation for time for lighted lights on a motor vehicle and OVI. Danny was given his copy of the citation, as well as, the BMV2255, and his breath test refusal results. Danny was transported back to his residence. The vehicle was legally parked on Danny’s property.
Animal Problem
On July 15th, 2024, at approximately 6:54 PM police was dispatched to 112 Oxford Drive in reference to a loose dog. PO observed a black and brown possible rottweiler mix running back and forth between 110 Oxford Drive and 108 Oxford Drive. A neighbor that was walking on the street advised PO the dog belonged to the subject that lives at 108 Oxford drive and that the dog runs through the neighborhood all the time. PO made contact with the keeper of the dog, Derrick Colbert at 108 Oxford Drive. Derrick restrained the dog and advised the dog broke the chain. Derrick advised the dog gets out of the fence around his back yard all the time. Derrick advised the dog belongs to his ex girlfriend and he has been harboring the dog for two and a half years. Derrick was issued a warning for the dog running at large on July 4th, 2024 at approximately 6:50 AM. Derrick was issued a citation for animals at large and was advised of his court date. After speaking to Derrick, PO spoke the complainant, Susan Hodges. Susan advised the dog has ran loose several times in the past. Susan advised the dog has been aggressive towards her in the past as well. Susan stated she saw the dog running through yards and trying to get into her trash can that she has in her drive way just prior to call the Greenville Police Department. Susan filled out a statement and victims right’ s form.
