Shoplifting

On July 30th, 2023 police was dispatched to 1501 Wagner Ave in reference to a theft complaint. Police made contact with the APA Jodi Edger, and the offender, Matthew Fitzgerald, in the loss prevention office. Edger showed police footage of Fitzgerald, “skip scanning” as Edger referred to it. Police observed on the video Fitzgerald placing a package of Oscar Mayer chicken breast on top of a bag of tater tots and only scanning the tater tots. Fitzgerald then placed both items into a bag. Edger explained that Fitzgerald made no effort to pay for the lunch meat. The total loss for this transaction was $8. 24. Edger advised Fitzgerald made it past all last points of sale and made it onto the sidewalk outside the business before she approached and stopped him. Edger stated the merchandise would not be returned to the shelf. Fitzgerald admitted that he knowingly did not scan the deli meat and that he was short on money. Fitzgerald was issued a misdemeanor citation for the theft. Edger completed a victims right form as well as a witness statement. Edger also gave a DVD footage of the incident that will be placed into property.

Theft

On August 01, 2023 at approximately 11:25 AM police responded to 524 Gray Avenue reference a theft complaint. Police made contact with the complainant, Joseph Buckley. Joseph stated he called Medicine & More to find out if his mother, Wanda’s prescription for 120-hydrocodone/acetaminophen combination pills were ready to be picked up. Joseph stated he was informed by Medicine & More staff that Wanda Buckley’s prescription had already been picked up by Jodie Cummins on 07/31/2023 at 4:55 PM. Joseph stated Jodie didn’t have permission to pick up the pills, and that Jodie never delivered the pills to 524 Gray Avenue where he and Wanda live. Joseph stated Jodie used to work as a home healthcare aide for Wanda at their residence, but Jodie was fired approximately one month ago due to her continuously stealing pills from Wanda’s medications. Police then responded to Medicine & More and made contact with employees David Mook and Debra Abernathy. David stated on 07/31/2023, a female subject called Medicine & More on three or four occasions, asking if Wanda Buckley’s prescription was ready to be picked up. David stated he checked the caller ID on the business’s phone and it showed that the caller was Jodie Cummins. Debra stated on 07/31/2023 at 4:55 hours, a younger, short female with brown hair arrived and picked up the prescription for Wanda Buckley. Debra provided a receipt for the prescription, which appears to have the name “Jodie Cummins” signed on it. Jodie and David completed written statements reference the incident. Police then contacted Jodie on a cellular phone number that Joseph provided. Jodie answered admitting to picking up the hydrocodone prescription on 07/31/2023, and she admitted to knowing that she had previously been fired by Joseph and Wanda. Jodie stated she personally dropped off the prescription to Wanda immediately after picking it up from Medicine & More. When asked why she would pick up the prescription for Wanda while knowing that Joseph and Wanda fired her, Jodie stated that she still helps Wanda ”here and there” but wouldn’t elaborate further. When police advised Jodie that her statement doesn’t make sense, Jodie stated Joseph probably stole the pills and sold them. Joseph completed a written statement and a victim right’ s form on Wanda’s behalf. Nothing further at this time.

Wanted Person/Fugitive from Justice

On August 3, 2023 at approximately 9:26AM police was dispatched to 1199 East Russ Road Apartment EB, Hunter Oaks in reference to a wanted person. Officers of the Greenville Police Department arrived to execute an arrest warrant on the defendant; Kevin J. Foster at the listed address which is the known residence for Mr. Foster. Upon Officers arrival, Mr. Foster’s vehicle bearing Ohio registration, JZH3245, was observed in the parking lot. Officers knocked on the apartment door multiple times attempting to make contact with Mr. Foster. At approximately 9:34AM, a PO observed who he knows to be Kevin J. Foster, look out a window from the second floor apartment #EB. Now, having knowledge that Foster was in the residence, Officers continued to knock on the door, announcing themselves, and also made attempts to contact him via telephone. They were unsuccessful with both. Officers stayed at the residence, maintaining a constant visual of all entry/exit points. At approximately 10:28am, a Detective met with Darke County Common Pleas Judge Fliehman, and a search warrant was issued to enter the residence of Mr. Foster and execute the bench warrant of arrest. Once the Detective arrived on scene with the search warrant, it was shown to the property manager, who in turn gave a key for access into the apartment. Police officers, prepared to make entry into the apartment. A PO placed the key into the lock, at which point Mr. Foster opened the door and surrendered. Mr. Foster was placed under arrest, in handcuffs, behind his back. Police placed Mr. Foster into the backseat of a cruiser and transported him to the Darke County Jail, where he was incarcerated on his warrant for failing to appear on an original charge of Fictitious Plates, as well as a new charge of Obstructing Official Business, a misdemeanor of the 2nd degree. Mr. Foster was searched incident to arrest with no contraband being found. Mr. Foster was read his Miranda Rights and acknowledged understanding. At 1:19PM Mr. Foster was served his copy of the citation and advised of his mandatory court date. Other people were located inside of the apartment during the search warrant and were released from the scene after briefly being detained.

Theft

On August 3rd, 2023 at approximately 7:02PM police was dispatched to 420 Front Street in reference to theft not in progress. Police made contact with Shontee Chalfant. Shontee stated that she had a $120 pair of headphones in a green case taken from her house and that they were pinging near 321 Washington Avenue. Shontee stated that her kids that use the headphones do not walk on Washington Avenue. Shontee stated that she feeds many of the children in the neighborhood and she thinks one of them may have taken the headphones. Shontee stated that she needed a police report for apple so that she can possibly get her headphones replaced. Police advised Shontee that police would go speak to the resident at 321 Washington Avenue and check the sidewalk area. Police went to 321 Washington Avenue and spoke with Robert Strait. Robert stated that he had not seen any headphones and that he did not have any children that lived with him. After speaking with Robert, police checked the sidewalks in the area. Police spoke to several neighbors and none of them had seen any headphones. Police went back to Shontee’s residence and advised her that a report would be taken. Police advised Shontee to contact police if she gets another ping on the headphones or if she hears anything else about them. A victim’s rights form was issued to her.

Disorderly Conduct

On August 3rd, 2023 at approximately 8:32PM while on patrol police observed a female stumbling on the sidewalk in the 700 block of Wayne Avenue. The Darke County Sheriff’s Office had received a call about a female walking into Greenville on Meeker Road wearing a black shirt. The caller advised the Sheriff’s Office that she may have been in an altercation. The female police observed matched the description of the subject that the Sheriff’s Office was looking for. Police got out of the cruiser and attempted to speak with the subject later identified as Carla Weiser. Carla did not want to speak with police and continued walking away from police. Police observed that Carla was bleeding from her lips and nose. Carla had red marks on her neck and legs as well. Police asked Carla if she had been in a fight. Carla began to state that she did not want to go to jail. Carla stated she fell down on the sidewalk and busted her nose. Carla was stumbling while she was speaking to police and could not stand up straight. Police advised Carla to sit down. Carla dropped to the ground and laid down flat and began to cry. Police could smell the odor of an alcoholic beverage coming from Carla. Police asked Carla if she had been drinking. Carla stated she had a few drinks. Police called for a squad to come assess Carla. When squad arrived Carla refused treatment. Another P. 0. arrived on scene and advised that Carla had been arrested last night for disorderly conduct. The P. 0. advised that Carla had been extremely drunk last night and was behaving in the same manner. After speaking with the P.0. police asked Carla if there was anyone at her residence that would be able to take care of her. Carla advised Matthew Gantt was at her residence. Police made contact with Matthew by phone and he stated that he would take care of Carla. Carla was issued a citation for disorderly conduct and was advised of her court date. Carla was transported to her residence.
