Disorderly

On July 24, 2024 at approximately 5:19 hours, police responded to 318 North Gray Avenue in reference to a disorderly. Prior to PO’s arrival, dispatch advised him that the original complainant, Whitney Yeagle, was in the police department lobby with her sister Katlynn Yeagle. Whitney stated that her ex-boyfriend, Jimmie McDowell, was currently at her apartment attempting to retrieve property. While enroute to the police department to speak with Whitney, dispatch advised one of the neighbors had called stating Jimmie was now making verbal threats against them. Upon arrival on North Gray, PO observed Jimmie on the sidewalk speaking with two of the neighbors, Tristian Garner and Zachary Baker who were on the front porch. As PO exited the cruiser, a silver minivan quickly approached and pulled towards the sidewalk where Jimmy was standing. The driver, Michael Johnson, exited his vehicle and approached Jimmy while screaming. Michael would later be identified as another neighbor and the father to Whitney’s children. PO attempted to separate Michael from Jimmy so PO could get his side of events. While PO attempted to de-escalate the situation, Jimmy and Michael continued to argue and yell at each other. Michael stated that Jimmy has not been living at the address. Michael stated that Jimmy was attempting to get property out of the house that Whitney had already taken to Jimmy’s storage unit. Michael stated Jimmy was given his storage unit keys earlier and was aware of this but wanted to continue to cause issues for Whitney. Michael called Whitney to tell her he wanted her to come back to the residence. The two continued to escalate the situation by screaming at each other, so at this time PO requested additional units to the scene. Jimmy removed himself from the sidewalk and PO was able to speak with him. Jimmy stated that he had not been living at this address for multiple months but that he wanted to retrieve the rest of his property and be on his way. Jimmy stated that he believed Whitney and Katlynn broke into his storage unit and took property out of it. Jimmy had no evidence of this and again stated he wanted to get his property back and did not want a report. While talking to Jimmy, Michael continued to get agitated and scream at Jimmy and police. When questioned about what items he was wanting to retrieve, Jimmy stated that he had a “large black tote” and other miscellaneous items, as well as his “weed.” Upon other police’s arrival, the parties were separated. At this time, PO was able to speak with the neighbors Garner and Baker. Garner advised that when Jimmie arrived, he began throwing and kicking the ten potted plants Whitney had on the front porch. Garner advised when he approached Jimmie, Jimmie began threatening to kill him and Baker, as well as threatening to burn down the house. When questioned about these statements, Jimmie admitted to breaking all the potted plants but stated he did not threaten anyone. While speaking with Garner and Baker, the Yeagles arrived back at the address. PO spoke with Whitney who advised she and her children are the only residents of this address. Whitney stated she believed she had moved all of Jimmie’s property into his storage unit but would be willing to walk through the apartment with him and officers. As Whitney entered the apartment, she advised she wanted to press charges reference damages to everything on the porch. Whitney advised the items that Jimmie had destroyed were approximately worth $700. As Whitney led Jimmy and PO up the porch, Katlynn exited the apartment with a plastic bag containing 3 large mason jars of marijuana and threw the bag towards police on the sidewalk while yelling at Jimmie. As the jars collided with the sidewalk, broken glass hit the Sgt. in his boots and pants. Jimmie retrieved multiple jars of marijuana, large empty water jugs, large plastic totes of soil and miscellaneous items from inside the residence. After gathering all his items, Jimmie was warned for trespass from this address and left in the vehicle he arrived in. Katlynn cleaned up the sidewalk and broken jars reference being advised she would subsequently be charged if she did not. Due to their actions during this incident, Michael Johnson and Katlynn Yeagle were verbally warned for disorderly conduct. Whitney filled out a written statement and a victim’s rights form in reference to Jimmie breaking items on the porch. Photos were taken of the porch and associated broken items. A citation was completed for Jimmie reference second degree misdemeanor criminal damaging. This citation will be placed into the briefing log and is to be served when Jimmie is located.
