Theft

On September 10th 2023 at 2:31 PM police was dispatched to 516 East Fifth Street in reference to license plate being stolen from a vehicle. PO spoke with the complainant Gregory Fernatt. Gregory advised while driving home from work today around 2:30PM his girlfriend Sarah Stewart informed him that the license plate to his 2010 silver Pontiac G6 was missing when they were retuning home from Kroger, where they both work. Gregory stated that the license plate was securely fastened to his vehicle with two screws. Gregory does not recall the last time he noticed the license plate on his vehicle. He believes the plate was stolen around the same time his passenger side rear view mirror was missing. He noticed the mirror was missing on September 6th around 6am. There was no noticeable damages to the mirror or the area where the license plate was mounted. Both screws were also missing from the license plate area on the vehicle. After speaking with the Gregory and Sarah, PO went to Kroger to review security footage of the parking lot on September 9th and 10th. In the security video, Gregory’s vehicle is to far away to see if his license plate was on the vehicle.The license plate bearing KAV6986 was entered into LEADS/NCIC as stole.

DUI

On September 10, 2023 around 2:02 AM police witnessed the vehicle being driven by the defendant traveling eastbound on Martz St towards Sweitzer St. The defendant approached the stop sign, slowed for it, but did not come to a complete stop. The defendant entered the intersection and turned southbound onto Sweitzer St. After making the turn the defendant “peeled out” and started to swerve. The defendant crossed into the northbound lane and drove there while trying to regain control of the vehicle. After the defendant got back into the southbound lane PO activated his overhead emergency lights indicating for the listed vehicle, which the PO could now see was a 2013 Chevy Camaro ( KBJ3195), to stop. The vehicle eventually stopped in the driveway of 1000 Central Ave. When PO approached the drivers side PO located the defendant, known now to him as Jose Alejandro Sapien Ayala, in the drivers seat. Jose had a noticeable odor of an alcoholic beverage around his person, along with glassy, bloodshot eyes. PO noticed Jose had limited ability to speak English but every question PO asked he claimed he understood after PO confirmed that he understood what he was asking him. Jose admitted he did not have a drivers license, only a passport from Mexico. Jose was unable to produce this information. Jose was only able to produce an insurance card with his name on it. The vehicle was in Jose’s name though. PO asked Jose if he had been drinking alcohol and he replied “not many”. Another PO arrived on scene and assisted the PO who had Jose exit the vehicle and asked him to perform some field sobriety tests. Jose confirmed he understood and agreed to the tests. The first test was a eye nystagmus test that he performed poorly on with the PO getting all 6 clues. Jose was then shown the one leg stand test. Jose did not count out loud, put his foot down, and swayed back and forth about 1 inch while PO gave instructions. On the walk and turn test the defendant moved his feet while PO gave instructions. Given the clues, odor of an alcoholic beverage around Jose’s person, and his reckless driving PO believed that Jose was operating a vehicle intoxicated. Jose was arrested for OVI and placed in handcuffs. Jose was transported to the Greenville PD where he was read and shown the BMV 2255 form. Jose advised he understood it but then wanted an interpreter. An interpreter translated the BMV 2255 form to Jose. Jose agreed to a breath test on the Intoxylizer 8000. After 2 tries the machine timed out and was unable to get a sufficient sample from Jose. It is unclear if Jose was blowing into the machine. Jose was issued a citation for Lanes of Travel, No Drivers License, and OVI. Jose was placed under an immediate ALS and went down as a refusal for not being able to produce a viable breath sample. Jose was released to his friend, Daniel Delgado. Around 6:30 AM police went back to 1000 Central Ave and spoke with Jose. Jose was able to produce a photo ID from a passport verifying all the information he had told police, which also matched the vehicle information from the BMV.

Wanted person/Fugitive from Justice

On September 9th, 2023 at approximately 7:05 PM police was dispatched to 805 Sater Street in reference to wanted person complaint. The complainant advised that Michael Workman was at the listed address and had an active warrant. PO made contact with Michael and he provided P.0. B. Conley with his driver’s license. Another PO ran Michael’s driver’s license through dispatch. Dispatch advised that Michael did have a warrant from Miami County. Dispatch confirmed the warrant through Miami County, for failure to register; no bond. Michael was placed in handcuffs and placed in the back seat of the cruiser. Michael was transported to the Darke County Jail and was released to jail staff.

Wanted person/Fugitive from Justice

On September 9th, 2023, at approximately 2:34 AM police observed a Gray 2005 Chevy Tahoe being operated west bound on Martin Street near Integrity Place. PO was sitting on Martin Street near Ohio Street. When the vehicle was within visual distance of the PO the listed vehicle pulled into 841 Martin Street. The listed business was closed and the gas pumps did not work after hours. Once the vehicle stopped a male subject exited from the driver seat and opened the hood. After several minutes the hood closed and the male subject got back into the driver seat. The vehicle then traveled east bound on Martin Street in the opposite direction of the PO’s cruiser. PO followed the vehicle and immediately after he got behind the vehicle it pulled over to the side of the road. The vehicle now had it’s hazards on and the same male subject started to exit from the vehicle. PO pulled behind the vehicle to see if they needed any assistance. PO activated the rear emergency lights only due to being on the side of the road. The male subject approached the PO and advised his car was having transmission issues. PO asked a few questions before asking the male for his name. The male advised he just had his wallet stolen. PO asked for his name and date of birth. The male subject advised Dwayne J. Cole 09/12/1979. When giving the answer the male seemed unsure about his response as if he had to think about his answer. PO was unable to find anyone through LEADS/NCIC with that name and DOB. After further investigation PO was able to confirm through LEADS/NCIC that the male subject was Joseph D. Cole 09/12/1977. Through LEADS/NCIC Joseph was found to have an active felony child support warrant through Indiana, no bond. The warrant was confirmed and Joseph was placed under arrest. Joseph was placed into the rear of the cruiser and transported to DCSO. Through LEADS/NCIC Joseph’s Indiana Driver’s license were also confirmed to be suspended. Joseph was also issued a copy of his traffic citation.

Disorderly Conduct

On September 8, 2023 at approximately 5:03 PM police responded to 800 Washington Avenue reference a possible assault. PO made contact with Samantha Day. Samantha stated that she was inside of the house at 800 Washington Avenue, when she went out to the garage to try to find a skateboard. Samantha stated that Geannette Henning and Linda Delk were standing in front of the garage. Samantha stated that Linda began yelling at her because Linda believed Samantha had broken some of her property. Samantha stated that Linda then pushed her and smacked her with an open hand on her chest. Samantha did not have any visible injuries. Samantha filled out a written statement and a victims rights form. PO I also spoke to Geanette about the incident. Geanette stated that she was outside with Linda when Samantha came outside. Geanette stated that Linda was upset because she believed Samantha had broken a swing that belonged to her. Geanette stated that Linda then pushed Samantha, before she was able to separate them. Geanette filled out a written statement. Another PO was also present and spoke to Linda. Linda admitted to pushing Samantha in the chest. While the PO was speaking to Linda in the garage, she opened a drawer. Inside of the drawer the PO observed in plain view a small bag of Marijuana, a marijuana grinder, and two marijuana smoking pipes. Through investigation it was determined that the items belonged to Samantha, and her boyfriend, Joseph Mccreery. Samantha admitted that all of the listed items belonged to her and Joseph. Joseph did not directly admit to possessing them, but stated that he had a medical Marijuana card, but could not provide it. Samantha and Joseph were issued misdemeanor citations for Marijuana Paraphernalia. Linda was also issued a misdemeanor citation for disorderly conduct reference pushing Samantha. All subjects were advised of their court dates.

Assault

On September 7th 2023 at 5:14 PM police was dispatched to the intersection of Russ Road and Oxford Drive, in reference to an assault. PO made contact with the complainant/victim Nakysha McNutt. Nakysha stated while while walking northbound on Oxford Drive with her friend Brenda Black and Brenda’s two juvenile children, a black pickup truck pulled up next to them. Kevin and Kelly Foster exited the vehicle and began arguing with Nakysha and Brenda about clothes that were given to Nakysha by Kevin. Nakysha and Brenda both stated while arguing with Kevin and Kelly, Kelly struck Nakysha with a closed fist on the right side of her head one time. The right side of Nakysha’s head near her ear was visibly red compared to the left side of head. Brenda recorded the interaction with her cell phone. In the video you are unable to see Kelly strike Nakysha, however you can hear what sounds like Nakysha being struck by Kelly. After the interaction Kevin and Kelly got into their vehicle leaving the scene and travelling eastbound towards there home residence at 1199 Russ Road, Hunter Oak Apartments. apartment ES. PO was unable to make contact with Kevin or Kelly at there residence. Statements were collected from both Nakysha and Brenda. Nakysha completed a victim’s rights form. Brenda advised that she would E-mail the video to the PO. The video will be added to this report when available. Photos were Taken of Nakysha, On September 8th 2023, PO made contact with Kelly and Kevin Foster at 1199 Russ Road apartment ES. Kevin and Kelly both stated that they were flagged down Nakysha because she was yelling at them in there vehicle. When exiting the vehicle both Kelly and Kevin stated that Nakysha was yelling at Kelly and shoved her multiple times and struck her in the left side of the neck. Due to conflicting statement and the video from the phone unable to see the altercation. Both Kelly and Nakysha did not want to press charges.

Unruly/Delinquent Child

On September 9th, 2023 at approximately 8:22 PM police was dispatched to 320 Eleventh Street in reference to a runaway Juvenile. POmade contact with Abigail Harshman. Abigail stated her son had run away. Abigail stated she and her son had gotten in an argument about her son smoking cigarettes. Abigail stated she took her son’s phone and he became angry. Her son’s friend stated that he saw the juvenile running west bound on Eleventh Street but could not catch up to him. Abigail stated that she did not know where her son might be going. Abigail stated her son was wearing a black Joey Votto jersey and red shorts. Abigail stated that she did not want her son charged with anything but just wanted him to be returned home. After speaking to Abigail, police patrolled the area in attempt to locate the juvenile. One PO spoke to several juveniles on Martin Street and they stated they saw the juvenile walking to the Car Show on South Broadway street. Police conducted foot patrol at the car show and were unable to locate the juvenile. The PO continued to patrol the area and was unable to locate the juvenile. A BOL was entered into LEADS/NCIC reference the juvenile being a runaway.

Wanted person/Fugitive from Justice

On September 11th 2023 at 8:20 PM police was dispatched to Greenville City Park near the intersection of Memorial Drive and East Water Street in reference to a suspicious person. PO located a male and female subject on a park bench behind the Boy Scout Fort. PO made contact with the two subjects who identified themselves as Damon Dickey and Kaylee Hines. PO had prior Knowledge that Kaylee had a warrant for her arrest out of the GPD. Kaylee was placed in handcuffs. GPD dispatch confirmed Kaylee had an active warrant out of Greenville Police Department for a failure to appear on an original charge of criminal trespass with a bond of $275.00. Kaylee stated that she had a syringe in her bra. Kaylee advised that the syringe belonged to Damon and that she was holding it for him. A female deputy responded to the scene where she searched Kaylee In front of the cruiser dash camera. The syringe was located by the Deputy. The syringe was an unused syringe with no contraband in it, the syringe was then properly disposed of. Kaylee was transported to Darke County Jail where she was incarcerated with a bond of $275.00.
