March 23
On March 23, 2023 at 1:15AM police was dispatched to 835 Sweitzer Street, Wayne Healthcare in reference to an assault. Police made contact with Edward Elliott and his juvenile son in the parking lot. The child victim will be referred to as C. V. from here on out. Police observed that C.V. had several lacerations to his head and blood running down his face and neck. Edward and C.V. stated C.V. was assaulted by Seth Smith and Benjamin Chaney in the 200 block of Sherman Street with baseball bats. Police advised Edward and C.V. to check into the ER and that police would be back to speak with them. Police then began checking the area for the two suspects and did not locate anyone. Police returned to Wayne ER a short time later to speak with family. Police began speaking with Edward at this time. Edward advised he and C.V. were at Wayne ER to visit C. V.’s friend who was in an accident. Edward stated that he and C. V. went out to his truck to sit for a while, which was parked in Wayne Healthcare’ s ER lot. He stated that C.V. was getting messages from Seth Smith and Benjamin Chaney advising him they were there to fight him. Edward stated that C. V. got out of the truck and walked to the 200 block of Sherman Street, where Seth and Benjamin exited a dark colored SUV. Edward stated he then heard what sounded like a baseball bat and ran to the scene, tackling who he believed to be Benjamin and advised him to stop. Both Seth and Benjamin got back in their vehicle and left the scene. Police then began speaking to C. V. C. V. stated that he has had ongoing issues with Seth Smith and Benjamin Chaney but nothing recently. He stated that Seth has been harassing him the last couple of days about fighting. C. V. stated he finally had enough and on 3/22/23 he told Seth that if he wanted to fight, to come out and he would fight. C. V. stated he received a message from Seth on this date while sitting in his father’s truck and C. V. advised him he was at Wayne ER. C. V. stated that Seth and Benjamin advised him they were there, and he exited the truck and walked to the 100 block of Sherman Street. C. V. advised this is when Seth and Benjamin got out of their vehicle and started assaulting him with baseball bats. C. V. stated his father then helped break up the assault and Seth and Benjamin left the scene. Police began searching the 200 block of Sherman Street for evidence and located two baseball bats laying on the North side of Sherman Street in the 200 block. Both baseball bats had blood on them. Police made contact with, Kelly Spahr. Kelly is an employee at Wayne Healthcare and was working the front desk at the time of this incident. Kelly stated that Seth Smith came in the lobby and asked to use their telephone. She advised he then exited, and came back in shortly after stating that his friend was getting beat up. Police contacted Wayne Healthcare Security in reference to video footage. Police attempted to contact Seth and Ben in reference to this incident but has been unsuccessful, and no good addresses for either are known.
Traffic Stop, Possession/Abuse of Drugs
March 27
On March 27, 2023 at approximately 10:20PM while on patrol Police observed a 2001 blue Chevrolet Monte Carlo traveling eastbound on Sater Street at Markwith Avenue. Police checked the vehicle’s registration in LEADS/NCIC and learned that the vehicle’s license plate was registered to a 1999 black Chevrolet station wagon. Police initiated a traffic stop on the vehicle and made contact with the driver, Scott Wilt. Upon approaching the vehicle police could smell the odor of marijuana coming from inside the vehicle. Police also observed a cloth Crown Royal liquor bag on the passenger side backseat floorboard inside the vehicle, that had plastic bags sticking out from it. Police asked Scott what was inside the Crown Royal bag, and he stated that it contained marijuana, before he reached for the bag and handed it to the police. Police opened the bag and found fifteen small plastic bags containing green leafy substances, a glass pipe with burnt residue, a metal grinder, and two glass jars containing green leafy substances inside. Several of the plastic bags had “XXX” written on them with a marker. One of the plastic bags had “Something special” written on it, and one of the plastic bags had “green” written on it. Police asked Scott and his passenger who is a juvenile, to exit the vehicle and then searched the vehicle and located two prescription pill bottles inside the center console. Each of the prescription bottles had the labels removed from them. One bottle contained pills which were not a controlled substance. The other pill bottle contained one 5mg/325mg oxycodone/acetaminophen combination pill, a plastic bag containing a whitecrystal-like substance, and a second plastic bag containing a white powdery substance. Police then located another plastic bag containing a crystal like substance, in the center console underneath the pill bottles. Scott stated that the non-controlled substance pills belonged to him, but the unknown substances were not his. While searching the vehicle, police found several documents that each had Scott’s name on it in the center console and glovebox. The unknown substances, the glass pipe and the metal grinder were seized and placed into property. The unknown substances will be sent to the BCI laboratory for analysis and charges are pending. Police issued Scott a citation reference driving under suspension and fictitious license plates.

On March 29, 2023 at approximately 11:14 AM police was dispatched to the Darke County Courthouse, 504 South Broadway St, in reference to a wanted subject, Zackariah Kroft. Police located Zackariah in the Adult Probation Office. Zackariah was issued his copy of the warrant out of the Greenville Police Department for failing to appear on the original charge of driving under suspension. Judge Monnin decided she would see Zackariah, for a trial, on the Greenville Police Department warrant at that time. While police waited for Judge Monnin to see Zackariah, police decided to run his social security number and found Zackariah had a warrant out of the Mercer County Sheriff’s Office for a probation violation, with the original charge of possession of a dangerous drug. After Zackariah’s trial he was arrested on the Mercer County warrant alone, with the Greenville Police Department warrant being taken care of. The warrant out of Mercer County was confirmed through Dispatch and they requested for police to transport Zackariah half way to meet. Zackariah was placed in handcuffs and was transported to the Darke/Mercer County line where he was released into the custody of Deputy Strohl with the Mercer County Sheriff’s Office.

March 28
On March 28, 2023 while assigned as the SRO at the Greenville High School, police was approached by Clayton Westerbeck, Assistant Principal at the Greenville High School, about a student who may have a THC vape pen on his person. Clayton and the police then walked to the classroom in which the juvenile was in and pulled him out to speak with him. They brought him back to Clayton’s office and asked him if he had anything on him. The juvenile immediately admitted to being in possession of the listed THC vape pen and pulled it out of his pocket. The juvenile handed the vape pen over to the police, which was multicolored and had a marihuana leaf branded on it. He also admitted to me the vape pen contained THC and was his.
Suspicious Person/Vehicle
March 29
On March 29, 2023 at approximately 10:04PM police responded to 201 Wagner Avenue, Speedway, reference a suspicious person complaint. Police was advised that a female wearing a black jacket and blue jeans, was asking people for money inside of the store. The female had also stuffed merchandise into her pockets before entering into the bathroom. Police was also advised that she had been inside the bathroom for approximately 10 minutes. Police then made contact with who later was identified as Dawn Wilson. Police advised Dawn of the complaint. Dawn admitted that she was inside of the store asking for money, but stated the only thing she put in her purse were extra straws for her coffee. Police then asked Dawn if she had any identification. Dawn stated that she did not have any on her and provided the name Joy Kathleen Arnett with a birthday of 2/1/1974. Dawn also stated that she did not know her social security number. When asked how old she was, Dawn hesitated and provided an age of 47 and 49. Dispatch gave a physical description for this subject as 5’4 with green eyes. Police noticed that Dawn had brown eyes and was taller than 5’4. Dawn then admitted that she gave her daughters information because she thought that she had a warrant for her arrest. Dawn then provided her correct name and birthday. Dispatch checked Dawn through LEADS/NCIC and learned that she did not have any warrants for her arrest. Dawn was issued a citation for Falsification and advised of her court date.

On March 29th, 2023, at approximately 10:39 PM police observed a white 2003 Hyundai Sonata traveling north on Walnut Street at East Main Street. Police checked the vehicle registration and confirmed the owner of the vehicle had an active Felony Warrant through the Darke County Sheriff’s office for probation violation, original charge possession of drugs; no bond. Police observed the operator of the vehicle matched the physical description of the owner to the vehicle. A traffic stop was made on the listed vehicle in the 100 block of East Main Street. Police approached the vehicle and confirmed the operator to be the owner. The owner and operator of the vehicle was Jessica Murphy. Police identified the subject by her social security number. The warrant was confirmed and Jessica was arrested. Jessica was transported to the Darke County Jail and released to staff. The traffic stop occurred at 100 East Main Street, Circle Mart. Employees advised they did not want the vehicle left in the lot so Dillmans’ Tow Service was contacted. The vehicle was removed by Dillmans with no hold.
Warrant/Fugitive from Justice
March 30
On March 30, 2023 at approximately 5:21PM police observed who was identified as Ethan Albert standing in a yard at the intersection of Walker Street and Harrison Avenue. Police had prior knowledge that Ethan has a warrant through the Greenville Police Department for Failure to Appear for the original charge of Trespassing with a $250 bond. Dispatch confirmed the warrant and police placed Ethan under arrest into handcuffs. Ethan was searched incident to arrest with nothing located, and was then transported to the Darke County Jail where he was released to jail staff.
Telecommunication Harassment
March 29
On March 29th, 2023, at approximately 5:19 PM police was dispatched to 122 West Main Street, The Greenville Police Department. The complainant advised she received a phone call from her son who had been warned and cited before for telecommunications harassment. Police arrived to the Greenville Police Department and spoke to the complainant, Derhonda McNally. Derhonda advised that her son is Christopher Newberry, and he called her today around 11:38AM. Derhonda had a recording of the telephone conversation that police was able to listen to. You could hear a male subject who police was familiar with and knew it to be Christopher Newberry. Christopher says” Hey Mom it’s me”, and proceeds to talk about items he wants Derhonda to mail to him. Christopher is currently at Access Medical rehab facility which is where the number came from. Police was also able to see the time stamp on the call from 3/29/23 at 11:38 AM. Police was able to see records from March 6th, 2023, where Christopher Newberry was warned for telecommunications harassment. Also on March 11th, 2023, Christopher Newberry contacted Derhonda again and he was cited. Christopher pled guilty to this telecommunications harassment, case #23-CRB-001-0092, in Darke County Municipal court. Due to Christopher having a prior conviction for telecommunications harassment this case will be sent to the DCPO for felony charges.
Theft
March 30
On March 30th, 2023 police took a report of a theft that had occurred at 1501 Wagner Avenue; Walmart, located in the City of Greenville. The Asset Protection Associate Jodi Edger advised at approximately 3:15 PM on 3/30/23, she observed a female with “bleach blonde” hair inside the store. Jodi stated she observed the female select several items of merchandise from the Automotive, Paint, Home Goods, Cosmetics, and the Health and Beauty Aids departments. The female then concealed the items in a black purse she was carrying. Jodi advised as the female approached the General Merchandise side doors, the female made a phone call. She then passed all last points of sale and proceeded onto the sidewalk. Jodi stated she approached her and the female fled in a Grey Pontiac Aztec with Ohio registration HSU7524. Jodi also observed there to be a Miami County Sticker on the vehicle, with an expiration date 07-23. Jodi provided a DVD with video, as well as still photos of the female suspect, the vehicle she fled in and the driver of the vehicle who had seemingly also been in the store. Jodi completed a statement and advised she did wish to pursue charges, as well as have both women trespassed from Walmart. She advised the stolen goods totaled $76. 74. Police ran HSU7524 through LEADS and found that it returned to a Grey Pontiac SW out of Miami County, with an expiration date of 07-08-2023. Police found the vehicle to be registered to Sherry Rader of Covington. Sherry’s BMV photo resembled the still photo Jodi had provided as the driver of the vehicle. Dispatch contacted Miami County Sheriff’s Office who was able to provide a phone number for Sherry. Police called the number and received a voice mail greeting for “Sherry”.
Theft of MV Parts/Accessories
April 2
On April 2, 2023 around 09:49 AM police was dispatched to 530 E Third St in reference to a catalytic converter stolen off a vehicle in the last week. Police spoke to the victim, John Lore. John told police that sometime between March 25, 2023 and the morning of April 2, 2023 an unknown suspect cut off the catalytic converter of the listed vehicle, a 2001 Dodge Ram truck (JUD8426). The Dodge was parked near the alleyway, in the backyard, at the time of the theft. There were no visible cameras in the area. The Dodge was parked behind a garage and not visible to any houses except 527 E Main St. Police made contact with the resident at 527 E Main St. The resident advised around 01:30 AM she noticed a stocky, middle aged man, approximately 5′ 7″ walking in the area. The man appeared to be suspicious and was just hanging around vehicles for several minutes. The resident did not see the subject commit any crimes but thought it was suspicious.
